AN ORDINANCE GRANTING VARIANCES
TO THE SUBDIVISION DESIGN STANDARDS
(Podromos Property, Short and East Streets, Lemont, Illinois)
WHEREAS, the John Podromos, hereinafter referred to as "the Petitioner ", desires
to grant variances to the Subdivision Design Standards on a 1.4 acre parcel hereinafter
referred to as "the subject property ", located on the west side of East Avenue, north and
south of Short Street, and 2 Tots on the east side of East Avenue in Lemont, Illinois and
Legally described in Exhibit "A "; and
WHEREAS, the Petitioner made application under the provisions of the Lemont
Design Standards and Subdivision Regulation Ordinance for the purpose of constructing
roadway improvements proposed to be incorporated as part of the single family and town
home development; and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois,
in accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on
December 16, 1997; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner
provided by law and was published in the Lemont Reporter, a newspaper of general
circulation within the Village; and
WHEREAS, the Lemont Planning and Zoning Commission has recommended
approval of the variations to the Subdivision Design Standards; and
WHEREAS, the President and Board of Trustees of the Village have determined
that the best interest of the Village will be served by the approval of this petition granting
variations for the subject property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: That the petitioner, the Village of Lemont, be granted the following
variations:
1. To allow a proposed 8.74% grade profile on Short Street instead of the maximum
permitted 8.0% grade.
2. To allow a vertical curve to be 190 feet in length instead of the minimum required
300 feet.

Re: A petition by John Prodromos requesting two (2) variance to the Subdivision Design
Standard to allow for the construction of roadway improvements proposed to be incorporated as
part of the single family and townhome development.
Dear Mayor Kwasneski and Village Trustees:
The Planning and Zoning Commission conducted a public meeting/review on the above noted
case on December 16,1997. The petitioner, John Prodromos, represented by Robert Kenny,
Attorney at Law, is proposing to construct a single family and townhome development. As part
of the development the petitioner is required to complete a number of public improves including
the improvements to East Street as a through street and Short Street extension, ending at East
Street, creating a "T" intersection.
The petitioner is requesting two (2) variances, both relating to the public roadway improvements.
As part of the Short Street improvements the petitioner is requesting approval of a variance to the
maximum grade requirements for the public roadway. The roadway grade variance is to the
maximum grade profile for the Short Street improvements only. The plans indicate a proposed
8.74 ° /o grade profile in lieu of an 8.0% maximum grade level, required in Village Design
Standards.
The second variance relates to the vertical curve requirements for East Street. The petitioner is
requesting a variance to the minimum vertical curve design standards on East Street, proposing a
vertical curve of 190 feet, where the Subdivision Regulations require a curve of 300 feet.
The Commission heard testimony by the Village Planner and petitioner. No members from the
audience spoke regarding the petition. Following careful review of the request, the Planning and
Zoning Commission voted 4 -0 in favor of the two (2) variances to the design standards.

The meeting of the Lemont Planning & Zoning Commission of the Village of
Lemont was held on Tuesday, December 16, 1997, at the Village Hall. The
meeting was called to order at 7:05 p.m. by Tom Metzger. The following
commissioners were present: Ellen Pearson, Ron Stapleton and Scott
Studebaker. Absent: Terry Duffy, Gary Gray and Katherine Murphy. The
following staff was also present: Scott Buening, Joanna Littrell, Jim Perry, and
Lisa Wuethrich.
A motion was made by Mr. Stapleton and seconded by Ms. Pearson to approve
the minutes of the December 2, 1997 meeting. Motion carried 4 -0.
NEW BUSINESS
A. 97.35 Request for two (2) variances to the Design Standards and Subdivision
Regulations to permit the construction of a townhome and single family
residential development, located at Short Street and East Street.
Mr. Perry reminded the commissioners that this is a public meeting, not a public
hearing. Mr. Perry said that two variances are being requested for the public
improvement of this development, which consists of five parcels that are already
platted as part of a subdivision. Variances are being requested for the maximum
grade requirement on Short Street and the vertical curve radius on East Street.
Mr. Perry said that the 8.74% Short Street grade variance is similar to the curve
at State Street south of Illinois Street, which is a 9.5% -10% grade, or Freemont
Street, which is approximately a 10% grade.
Mr. Perry said that the proposed 190 foot vertical curve on Short Street, instead
of the required 300 foot vertical curve, will create a "T" at the East Street

intersection, with no plans to connect through to Hillview Drive. Mr. Perry said
that the petitioner is asking for the variance basically to minimize the amount of
grading and soil requirements and to save on construction.
Mr. Stapleton asked what type of barrier will be put at the end of Short Street.
The Village Engineer, Joanna Littrell, said that there will be a stop sign and
barrier curb. Ms. Littrell said that more landscaping can be done as an added
barrier.
Bob Kenny, attorney for the petitioner, said that he had nothing further to
present.
Mr. Metzger asked if the single family lots and townhouse units will be built
simultaneously. Mr. Kenny said that he is not sure, but knows that the landowner
wants to build as much as possible as e Mr. as possible. r. Kenny said that htepsenot sure
how many townhouse units there will
because plans have not been drawn up yet, pending the outcome of the petition.
Mr. Perry said that staff does not have a problem with the proposed
improvements from a safety point of view and the variance request does not
exceed IDOT standards for the minimum vertical curve requirements.
Mr. Metzger asked how the newly constructed East Street and existing East
Street will connect. Ms. Littrell said that the newly constructed East Street will
taper in to meet the existing East Street, but the center of the road will remain
constant, versus realigning the street, which would cause a kink in the road.
A motion was made by Mr. Stapleton and seconded by Ms. Pearson to approve
case number 97.35 request for two (2) variances to the Design Standards and
Subdivision Regulations to permit the construction of a townhome and single
family residential development, located at Short Street and East Street. Motion
carried 4 -0.
OLD BUSINESS
A. 94.02 Request for an amendment s service station Special Use prmit
variances the
construction of an automotive es located at
McCarthy Road and Archer Avenue, also known as Amoco Oil Inc.
Mr. Perry said that the petitioners are still requesting variances for the canopy,
the rear yard building encroachment, the western, eastern and southern internal
drives, the minimum requirements to the landscape ordinance and the driveway
setback adjacent to McCarthy Road. Mr. Perry said that the parking variance has
been eliminated and alternatives for the sign variance have been given.

The petitioner is proposing to develop two (2) single family residential lots on the east side of
East Street. The petitioner is also proposing several town house units on the west side of East
Street where the property is zoned R -6, Multifamily Residential. The property encompasses a
portion of the Lemont Gardens Subdivision, subdivided of 1964 and Keough & Spalding
Resubdivision of November 4, 1885. See Exhibit "A ".
The development will be incorporating a number of roadway improvements, required to gain
access to the proposed building sites. The roadway improvements include the extension of East
Street, as a fully improved north/south local roadway. Short Street will be improved up to the
East Street extension, creating a "T" intersection. Please note there are no plans to continue
Short Street through to Hillview Drive.
This public meeting is required for two (2) variances, both relating to the public roadway
improvements. The proposed construction of Short Street will required a variance to the
maximum grade requirements for a public roadway and East Street will require a variance to the
vertical curve design. The roadway grade variance is to the maximum grade profile for the Short
Street improvements only. The plans indicate a proposed 8.74% grade profile in lieu of an 8.0%
maximum grade level, required in Village Design Standards.
In addition, the petitioner is requesting a variance to the minimum vertical curve design standards
om East Street. The petitioner is proposing a vertical curve on Short Street of 190 feet, where
the Subdivision Regulations require a curve of 300 feet.
Please note that both variances are to the Village of Lemont Subdivision Design Standards and
Subdivision Regulations.
STAFF RECOMMENDATIONS
Following a thorough review of the project and the variance requests and following a thorough
engineering review of the petition, staff feels comfortable in recommending a favorable staff
opinion of the variances. The variance requests are reasonable given the nature of the
topographic challenges of the property. Staff recommends approval of the variances based on the
following recommendation;
The development shall substantially conform to the site plan attached hereto as Exhibit "A ",
except as such plans may be changed to conform to the Village codes and ordinances;
