AN ORDINANCE APPROVING A SPECIAL USE (Kallemeyn Auto Rebuilders - 16039 New Avenue, Lemont, II.) WHEREAS Scott Kallemeyn, hereinafter referred to as "the Petitioner," is the owner of an approximately +1- 2 acres parcel, hereinafter referred to as "the subject property," located at 16039 New Avenue, in Lemont, Illinois and legally described in Exhibit "A." WHEREAS the Petitioner made application under the provisions of the Lemont Zoning Ordinance of 1980 (No.426), for a request for a Special Use to allow outdoor storage in the M -1 District; and WHEREAS the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on March 3, 1998 for approval of the Special Use; and WHEREAS the Planning & Zoning Commission voted for approval of the Special Use; and WHEREAS a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter Progress, a newspaper of general circulation within the Village; and WHEREAS the President and Board of Trustees of the Village of Lemont, after a public hearing as required by law, approved the Special Use Permit; and WHEREAS the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit as described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: 2 SECTION 1: Special Use Approval. The subject property described above is hereby permitted to operate an outdoor storage facility in the M -1 District. SECTION 2: Conditions. Approvals shall substantially conform to the Site Plan, attached hereto as Exhibit `B ", except as such plans may be changed to conform to the Village code and ordinances and the conditions below; 2. The outdoor storage shall be limited to only camping trailers, recreational vehicles and boats. All vehicles stored must be operable and display valid vehicle registration. If the outdoor storage is expanded to include other types of materials it shall only be permitted upon Village Board approval; 3. The mobile home trailer shall be removed within 30 -days from the date of closing on the property; 4. The landscaping shall be completed within one (1) year from the date approvals are granted, attached hereto as Exhibit `B ". If the landscaping is not complete within the specified period, or an appropriate from of security posted with the Village, the permit shall lapse; 5. There shall be no outside overnight parking or outdoor storage of any material outside the enclosed area; 6. Any future development will require a separate special use approval if applicable; 7. The private drive outside the enclosed area and any areas used for parking for employees or visitors and maneuvering shall be paved with asphalt pavement; 8. Any additional lighting shall meet Village Standards. If additional lighting is proposed a photometric diagram shall be required for approval prior to final permits being issued. 3 PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DU PAGE COUNTIES, ILLINOIS, on this 27th Day of April 1998.
