AN ORDINANCE AMENDING LEMONT ZONING ORDINANCE NO. 0 -25 -99
(Sections VIII.F.2 and XVIII.J)
BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont,
Counties of Cook, Will, and DuPage, State of Illinois, as follows:
WHEREAS, the President and Board of Trustees of the Village have determined that the
best interests of the Village will be served by amending Section VIII. F.2 of the Zoning
Ordinance (B -4 Commercial - Recreation District) to add "Planned Unit Development" and
"Canal Overlay District" as authorized special uses in the B -4 District; and amending Section
VII. J (Administration & Enforcement, Amendments) to create a "Canal Overlay District. "; and
WHEREAS, a notice of a Public Hearing was made in the manner provided by law and
was published in the Lemont Reporter Progress, a newspaper of general circulation within the
Village, and said Public Hearing was held on April 20, 2004; and
WHEREAS, this ordinance changes the paragraphs of the Village of Lemont Ordinance
No.O -11 -00 of the Municipal Code Chapter Seven, Zoning Regulations as follows:
Section 1. That Section VIII. F. 2 (B -4 Commercial - Recreation District) add the following
as authorized special uses in the B -4 District:
"b. Residential, commercial, or mixed -use Planned Unit Developments; and
c. Canal Overlay District (COD) special uses on parcels having frontage on the Sanitary and
Ship Canal or the Cal -Sag Channel "; and
Section 2. That Section XVIII. J. (Administration & Enforcement, Amendments) be
amended to create a "Canal Overlay District ", attached as Exhibit A to this Ordinance; and
WHEREAS, the Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.

The following text is hereby added to Section XVIII.J (Administration and
Enforcement - Amendments)
4. COD Canal Overlay District
a. Purpose
The Canal Overlay District (COD) is intended to provide supplementary
land use regulations for areas that have frontage on the Main Channel of
the Metropolitan Water Reclamation District of Greater Chicago
(MWRDGC), also known as the Sanitary and Ship Canal. The rules of
procedure for application, review, hearing and approval of the Canal
Overlay District are the same as for zoning map amendments in general,
as enumerated in this subsection.
b. Permitted Uses
(1) All permitted uses of the underlying zoning district, plus:
(2) Boat and barge service and repair
(3) Ship building
c. Special Uses
(1) All special uses of the underlying zoning district, plus:
(2) Outdoor storage and transshipment of water -borne bulk materials
(3) Planned Unit Developments
(4) Recreational marinas
d. General Use Provisions and Restrictions
(1) Restriction on Outdoor Uses
Material stockpiles shall only be authorized by special use when related to
the loading and off - loading of bulk materials to /from vessels on the Main
Channel and when authorized by lease of property from the MWRDGC. In
such cases, site plans shall be filed indicating the area to be occupied by
the stockpile, type of product(s), maximum height of the stored material,
and methods of containment and stabilization of the stored material.
(2) Outdoor storage not related to marine operations shall be subject to
the standards of the applicable zoning district.

(3) Restriction on Number of Uses, Buildings and Structures per Lot.
Only one principal use shall be permitted per lot of record. No additional
use of land or additional buildings structures on a lot shall be permitted
unless said uses, buildings or structures are either: a) clearly accessory to
the permitted principal use; or b) occupy lots subdivided according to the
standards of the Village of Lemont Subdivision Regulations and this
ordinance; or c) authorized by planned unit development approval.
(4) Limited Residential Use
Residential use shall be generally prohibited, unless a special use approval
is granted for a watchman residence or resident - manager's quarters,
according to the special use procedure in Section XVIII of this ordinance.
(5) Limited Retail Use
Retail sales to the general public shall be generally prohibited, except for
retail sales of goods and services that are customarily incidental and
accessory to a permitted or special use in this District.
(6) Site and Structure Provisions:
(a) Minimum Building and Structure Design Standards
Shall comply with the standards for the applicable zoning district
(b) Performance Standards
All permitted and special uses shall comply with the provisions of Section
XI of this ordinance.
(c) Yards
Yards shall conform to the regulations of the applicable zoning district.In
addition, a minimum yard of 100 feet shall be provided from the edge of
the Main Channel (not including slips and turning basins) to the nearest
principal structure.
(d) Height
No principal building shall exceed a height of thirty -five (35) feet.
Accessory buildings and structures shall be subject to the height
restrictions of Chapter V, Section G. No bulk material stockpile shall
exceed a height of twenty (20) feet and shall otherwise comply in full with
the standards of Chapter 8.33 of the Lemont Municipal Code.
(e) Floor Area Ratio
The maximum floor area ratio shall not exceed the standard of the
applicable zoning classification.
(f) Off - Street Parking and Off- Street Loading
Off street parking and off- street loading improvements shall be provided
and maintained in accordance with Section XII of this ordinance.
(g) Landscaping and Tree Preservation
Landscaping and Tree Preservation shall comply with the provisions of
Section XIII of this ordinance.
(h) Fences
Fences shall comply with the provisions Section XIV of this ordinance.
(i) Signs
Permanent and temporary signs shall comply with the provisions of
Section XV of this ordinance.
