ORDINANCE NO.O •/6 -D 7 AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) ON A 5.50 ACRE PARCEL, LOCATED EAST OF ROSE COURT & WEST OF HERMES AVENUE FROM LEMONT R -1 (SINGLE FAMILY RESIDENCE DISTRICT) TO LEMONT R -4 PUD (SINGLE FAMILY RESIDENCE DISTRICT, PLANNED UNIT DEVELOPMENT) FOR LOTS 1 -6 & LEMONT R -2 PUD (SINGLE FAMILY RESIDENCE DISTRICT, PLANNED UNIT DEVELOPMENT) FOR ONLY LOT 7 IN LEMONT, ILLINOIS KNOWN AS MAEGAN MEADOWS SUBDIVISION WHEREAS, Ironwood Development Company hereinafter referred to as "the Petitioner ", is the acting agent for the builder /developer known as Morgan Builders of an approximately 5.5 acre parcel, hereinafter referred to as "the subject property ", located east of Rose Court and west of Hermes Avenue in Lemont, Illinois. WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a residential planned unit development to rezone approximately 3.66 acres to R -4 PUD (Single Family Detached Residence Planned Unit Development) which consist of Lots 1 -6 & approximately 1.87 acres to R- 2 PUD (Single Family Detached Residence Planned Unit Development) which consist of only Lot 7 of the preliminary plat referred to as Maegan Meadows from Lemont R -1 Zoning (Single Family Residence District), pursuant under Sections XVI and XVIII. I. and J. WHEREAS, the Plan Commission met on June 24, 2003 and has recommended approval of the request for a single family detached residential plan unit development (R -4 & R -2 PUD) to the Village Board; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on July 7, 2003, August 19, 2003 and February 2, 2004 and made a recommendation to the Village Board; WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, that the Petitioner, Ironwood Development Company be granted the requested single family detached residential plan unit development zoning (R -4 & R -2 PUD) from Lemont R -1 Zoning (Single Family Residence District). Section 1. A zoning map amendment is granted to allow the change in the zoning classification of the parcel located east of Rose Court and west of Hermes Avenue to R -4 & R -2 PUD Zoning (Single Family Detached Residence Planned Unit Development) from Lemont R -1 Zoning (Single Family Residence District), as illustrated in the Plat of Survey and legal description attached as Exhibit "A ". Section 2. As provided in Chapter XVI.I. Conditions to the Special Use — Planned Unit Development for Maegan Meadows Subdivision. 1. Lot 7 shall have a building line at the 150 foot lot width as required in the R -2 District. 2. Any exposed structures within the wooded portion of the drainage easement shall be designed to blend with the landscape and minimize disruption to the existing vegetation. 3. Additional contours and existing structures shall be shown on lots 6 -8 inclusive in Timberline Estates during final review of the detention basin. 4. Water and sanitary sewer services shall be provided to lot 7. 5. The fuel pipeline company must be provided plans for review and comment. 6. The encroachment of existing driveway on lot 3 shall be removed. 7. The Village arborist shall review plans for removal, preservation, and transplantation of mature trees. 8. Lot 7 shall not be resubdivided unless the PUD is amended as provided in Chapter XVI.F.2. Section 3. The Planned Unit Development approval shall lapse in the event the Petitioner does not file a complete application for a site development permit within one (1) year of the effective date of this AGREEMENT.
