AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A
COMMERCIAL PLANNED UNIT DEVELOPMENT (PUD) ON A 1.0 ACRE PARCEL,
LOCATED EAST OF HILLVIEW DRIVE ON 127TH STREET AND REZONING FROM
LEMONT R -1 (SINGLE FAMILY RESIDENCE DISTRICT) TO B -1 PUD (OFFICE RETAIL
TRANSITIONAL BUSINESS DISTRICT, PLANNED UNIT DEVELOPMENT) IN LEMONT,
ILLINOIS AT 15353 W. 127TH STREET KNOWN AS HILLVIEW PLAZA
WHEREAS, Kathy and Joe Dlugopolski, hereinafter referred to as "the Petitioner ", are the owners of
an approximately 1.00 acre parcel, hereinafter referred to as "the subject property ", located east of Hillview
Drive on 127th Street in Lemont, Illinois.
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance
for a commerical planned unit development to rezone the parcel to B -1 PUD Zoning (Office Retail
Transitional Business District, Planned Unit Development) from Lemont R -1 Zoning (Single Family
Residence District), pursuant under Sections XVI and XVIII. I. and J.
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said
Zoning Ordinance, conducted a Public Hearing on the petition on January 20, 2004 and February 17, 2004
and made a recommendation to the Village Board;
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and
was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of
Lemont, that the Petitioner, Kathy and Joe Dlugopolski be granted the requested commercial plan unit
development zoning (B -1 PUD) from Lemont R -1 Zoning (Single Family Residence District).
Section 1. A zoning map amendment is ranted to allow the change in the zoning classification of
the parcel located east of Hillview Drive on 127 Street to B -1 PUD Zoning (Office Retail Transitional
Business District, Planned Unit Development) from Lemont R -1 Zoning (Single Family Residence District),
as illustrated in the Plat of Survey attached as Exhibit "A ".
Section 2. As provided in Chapter XVI.I. Conditions to the Special Use — Planned Unit
Development for Hillview Plaza.
1. The site plan, preliminary engineering plan, landscape plan, lighting plan and architectural plan
are attached as Exhibit `B ". Development will have to be consistent with exhibits except where
changes are minor as defined in the ordinance, or the PUD is amended after a public hearing.
2. A design and preliminary calculations for on -site detention must be provided.
3. A landscape plan illustrating 100 percent screening/buffering of adjacent residences and other
Lemont landscaping standards must be submitted for review.
4. Details of the proposed lighting on the building and in the parking lot should be submitted and
become part of the PUD agreement.
5. The parking lot will have to allow fire access to the building sprinkler system, front doors for
deliveries and access to the refuse enclosure.
6. The trash enclosure /dumpster is required to be screened with masonry and prohibited in the rear
of the building.
7. Hours of operation & hours of lighting are limited to lam to l Opm, daily.
8. If the parking lot is moved south to align with the Palos Community Hospital parking lot, a fully
executed cross access agreement should be entered between the two property owners. Cross
access does not necessarily mean shared parking; individual owners could restrict usage by
signs.
9. The sidewalk in front of the building should measure at least seven feet wide to allow for vehicle
overhangs.
10. A six foot wide public sidewalk shall be installed along the 127th Street frontage as part of this
project.
11. The driveway should be wide enough (typically 35 feet) to accommodate right and left out-
bound movements and a single in -bound movement.
12. A cohesive sign program shall be provided so tenant space wall signs and ground sign panels (if
applicable) have a common size, sign type, color or style, and location on the building (see
sample staff exhibit).
13. A 50 foot (from center line) dedication of right of way on 127th street shall be illustrated on all
plans. Petitioner shall prepare a plat of dedication if such has not been prepared to date.
14. Cook County Highway Department should provide preliminary comments on access to the site
before approval by the Village Board.
15. Final plan review shall be coordinated with the 127th Street improvement (i.e., Village will
review plans for compatibility with planned improvements to the roadway by Cook County).
16. Uses other than the uses permitted in the permitted use list for the B -1 PUD referred to as
Hillview Plaza, attached as Exhibit "C ", will require an amendment to the PUD as provided in
Chapter XVI.F.2.
Section 3. The Planned Unit Development approval shall lapse in the event the Petitioner does not
file a complete application for a site development permit within one (1) year of the effective date of this
AGREEMENT.

VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS, on this 24th
