AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE TO PERMIT
THE CONSTRUCTION OF AN AUTOMOTIVE SERVICE ESTABLISHMENT
KNOWN AS JIFFY LUBE AT 15682 W. 127TH STREET IN LEMONT, ILLINOIS
WHEREAS, Preferred Development, Inc., hereinafter referred to as "the Petitioner", is the contract
purchaser of a parcel, hereinafter referred to as "the subject property", located at 15682 W. 127th Street in
Lemont, Illinois and described in the attached legal notice as "Exhibit A "; and
WHEREAS, the Petitioner made application under the provisions of Section VIII.E.2.n.& t. in the
Lemont Zoning Ordinance for a special use to develop an automotive service establishment; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said
Zoning Ordinance, conducted Public Hearings on the petition on May 6, 2004 & June 7, 2004; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and
was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and
WHEREAS, the Zoning Board of Appeals has not recommended approval of the request for a special
use to the Village Board; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interests of the Village will be served by approving the Special Use Permit by the standards of the Special Use
Procedures, Sections XVIII. I. of the Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL,
ILLINOIS:
Section 1. Conditions to Special Use. A special use is granted to Preferred Development, Inc., to
allow the construction of a automotive service establishment at 15682 W. 127t Street as illustrated in the
attached Site Plan ( "Exhibit B "), with the following conditions:
1. Final Plans shall substantially conform to the plans prepared by Compass Consulting
Group, last revised April 21, 2004, sheets C -1, C -2, C -3, C -4, C -5, ALTA/ACSM Survey,
Landscape Plan, and Photometric Plan attached as Exhibit `B ";
2. Final Plans shall substantially conform to the Building and Sign Elevations/floor
plan, prepared by Architects 127 +Assoc., revised May 27, 2004, three sheets,
including ground sign revised July 2, 2004 as Exhibit `B ";
3. Hours of operation & lighting (except security lighting) shall be limited from 8 a.m. to 7 p.m.,
Monday thru Friday, 8 a.m. to 6 p.m. on Saturdays and closed on Sundays;

4. The substitution of "Prairie stone" for split -faced concrete be used for the construction of the building;
5. The owner agrees to cross - access in the rear of the property with adjacent parcels.
Section 2. A special use shall lapse in the event of the following:
a. A complete building permit application has not been received by the Village for such
construction, installation, or relocation within one year after the effective date of the ordinance
granting said special use; or
b. A building permit has been issued within one year of the effective date of the special use, but
such construction, installation or relocation has not commenced within one year after the issuance
of the building permit.
c. In the event a special use lapses, nothing herein shall prohibit any person from applying for the
same special use or a new special use on substantially the same terms."
Section 3. That this ordinance shall be in force and effect from and after its passage, approval
and publication in pamphlet form as provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS, on this 12th
day of July, 2004.
