ORDINANCE NO. 0 ' ��" (J 'D AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) ON A 1.68 ACRE PARCEL, LOCATED NORTH OF TALCOTT AVENUE, WEST OF HOLMES STREET & REZONING FROM LEMONT B -2 & M -1 (HISTORIC CENTRAL BUSINESS DISTRICT & MANUFACTURING DISTRICT) TO B -2 PUD (HISTORIC CENTRAL BUSINESS DISTRICT MIXED USE PLANNED UNIT DEVELOPMENT) IN LEMONT, ILLINOIS AT 429 TALCOTT AVENUE KNOWN AS TALCOTT STREET DEVELOMPENT WHEREAS, Jerry Kulhanek, hereinafter referred to as "the Petitioner ", is the owner of an approximately 1.68 acre parcel, hereinafter referred to as "the subject property ", located north of Talcott Avenue, west of Holmes Street in Lemont, Illinois. WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a mixed use planned unit development to rezone the parcel to B -2 PUD Zoning (Historic Central Business District, Planned Unit Development) from Lemont B -2 & M -1 Zoning (Historic Central Business District and Manufacturing District), pursuant under Sections XVI and XVIII. I. and J. WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on February 2, 2004, May 6, 2004 & May 18, 2004 and made a recommendation to the Village Board; WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, that the Petitioner, Jerry Kulhanek be granted the requested mixed use planned unit development zoning (B -2 PUD) from Lemont B -2 & M -1 Zoning (Historic Central Business District and Manufacturing District). Section 1. A zoning map amendment is granted to allow the change in the zoning classification of the parcel located north of Talcott Avenue, west of Holmes Street in Lemont, Illinois to B -2 PUD Zoning (Historic Central Business District, Planned Unit Development) from Lemont B -2 & M -1 Zoning (Historic Central Business District and Manufacturing District), as illustrated in the Plat of Surveys attached as Exhibit «A„ Section 2. As- provided in Chapter XVLI. Conditions to the Special Use — Planned Unit Development for Talcott Street Development: 1. Final PUD plans shall substantially conform to the site plans, elevations, and floor plans prepared by Sullivan Goulette Architects and dated May 27, 2004 & June 1, 2004 attached as Exhibit `B "; 2. A preliminary engineering plan shall be submitted, reviewed, and recommended for approval by the Village Engineer prior to approval of the rezoning and PUD by the Village Board; 3. A landscape plan illustrating proposed street trees (ten total), site perimeter (one shade or ornamental tree per unit), building entry (shrubs, perennials, and groundcovers) and parking area landscaping (trees and shrubs) including type, size and quantity of all plants, and existing trees to be removed or preserved [most trees, including the large cottonwood at 507 Talcott and the numerous Tree of Heaven along the 1 &M Canal will have to be removed] shall be submitted for review by the Village landscape consultant; 4. Site details plans and elevations shall be submitted prior to final plan approval illustrating proposed construction of sidewalks, pedestrian ways (including decorative guide rail as needed), residential entry areas (including fences), mailboxes, refuse storage enclosures, sprinkler connection enclosure, street and site lighting, directional /instructional and regulatory signs, and a commercial tenant sign program. 5. On -site parking, standing and loading shall be restricted to designated areas. The developer and property owner shall execute a traffic agreement with the Lemont Police Department that allows the Lemont Police to enforce parking violations on private property. 6. This plan approval assumes the use of public parking lots and parking structures in central locations to satisfy commercial parking demands. Prior to final plan approval, the developer shall submit evidence that sufficient parking exists within 1,000 feet of the subject property to accommodate the planned 14,304 square feet of commercial space. A parking study that documents the availability of public parking within 1,000 feet of the site may be acceptable evidence if available parking totals are sufficient to absorb 14,304 square feet of retail space. The Village may waive the parking study requirement if an additional 53 public parking spaces [14,305 square feet x 4.5 spaces /1, 000 square feet —11 additional on- street spaces = 53 spaces] are provided by others within the 1,000 foot radius of the site. In the event a parking deficit is indicated by study, the developer shall provide on or off -site parking spaces in the amount of the deficit. [note: the 4.5:1,000 square foot ratio is for retail — actual use may include a combination of retail, office- service, and cafe /restaurant uses]. 7. Development shall proceed in the following sequence: Buildings D, A, B & C [Village Board recommendation]. 8. Approval of the site plan and acceptance of the Illinois & Michigan Canal dedication is subject to verification that the 15'8" path dedication is relatively level and free of obstacles, as indicated on the developer's topographic survey. 9. Prior to final plan approval, a declaration of property owners association including covenants, conditions and restrictions shall be submitted for Village review and approval. 10. Prior to final plat approval, the developer shall make donations to the elementary school district, high school district, and park district as required by the Village of Lemont Land -Cash Ordinance. Section 3. The Planned Unit Development approval shall lapse in the event the Petitioner does not file a complete application for a site development permit within one (1) year of the effective date of this AGREEMENT. Below is a draft motion for your consideration. Upon conclusion of the public hearing on case 23.18, the Zoning Board of Appeals makes the following recommendation: That the subject property in case 23.18 be classified as B -2 Historic Central Business District and a Preliminary Residential/Business Planned Unit Development Plan be approved, including the following variations of minimum requirements as provided in Section XVLH of the Lemont Zoning Ordinance: 1. The minimum front yard on Talcott Street shall be a minimum of eleven feet, four inches (11', 4 ") for all buildings; 2. The minimum rear yard on the Illinois & Michigan Canal shall be zero for building D; ten feet for Building A, and six feet for Building C, all measured after the dedication of a fifteen foot, eight inch public pedestrian right of way; 3. The minimum side yard shall be twelve feet (12'0 ") on from the west interior lot line and nine feet, four inches (9'4 ") from the east interior lot line (the latter as measured after the dedication of a 20 foot, eight inch (20', 8 ") public pedestrian /emergency access right of way; 4. Minimum lot area of the development, inclusive of pedestrian paths to and along the Illinois and Michigan Canal, shall be 72,980 square feet (1.675 acres); 5. Minimum building to building spacing shall be 30 feet side of building to rear of building and 50 feet rear of building to rear of building [measurement excludes stairs]; 6. Maximum building height shall be forty feet, ten inches as measured from grade to the top of the penthouse and 35 feet to the top of the parapet on buildings A, B, C; 31 feet from grade to the top of the parapet on building D; 7. The intensity of use shall be a maximum overall floor area ratio (gross floor areas of commercial and residential space, including garages) of 1.17; 8. Talcott Street, as reconstructed by the developer, shall have a width of 24 feet back of curb to back of curb, exclusive of eleven parallel parking spaces to be installed on the north side of the curb line as depicted on the site plan; 9. Public sidewalk, as constructed by the developer, shall be fifteen feet wide and shall be constructed of decorative paver materials consistent with the design of sidewalks on reconstructed Stephen Street. 10. On-site stormwater detention shall be underground. To the extent that space constraints exist that prevent detention on -site to the full extent required by the Standard Specifications, the developer shall be permitted to use the Illinois and Michigan Canal for storm water retention. 11. Two on -site parking spaces shall be provided per dwelling unit for a total of 72 on -site parking spaces. Parking space minimum widths shall be reduced from nine feet to eight feet, eight inches [note: the site plan indicates 8'6", but the reduction of the landscape islands to 8' instead of 10' will allow each space to be 2 " wider. The garage spaces are 17'4" wide or 2 x 8'87 An additional 11 public parking spaces on Talcott Street as depicted on the site plan. No on- site parking shall be provided for the commercial space. The Zoning Board further recommends several conditions and guarantees be adopted in the PUD as provided in Section XVI.I of the Lemont Zoning Ordinance: 1. Final PUD plans shall substantially conform to the site plans, elevations, and floor plans prepared by Sullivan Goulette Architects and dated May 17, 2004; 2. A preliminary engineering plan shall be submitted, reviewed, and recommended for approval by the Village Engineer prior to approval of the rezoning and PUD by the Village Board; 3. A landscape plan illustrating proposed street trees (ten total), site perimeter (one shade or ornamental tree per unit), building entry (shrubs, perennials, and groundcovers) and parking area landscaping (trees and shrubs) including type, size and quantity of all plants, and existing trees to be removed or preserved [most trees, including the large cottonwood at 507 Talcott and the numerous Tree of Heaven along the I & M Canal will have to be removed] shall be submitted for review by the Village landscape consultant; 4. Site details plans and elevations shall be submitted prior to final plan approval illustrating proposed construction of sidewalks, pedestrian ways (including decorative guide rail as needed), residential entry areas (including fences), mailboxes, refuse storage enclosures, sprinkler connection enclosure, street and site lighting, directionalinstructional and regulatory signs, and a commercial tenant sign program. 5. On -site parking, standing and loading shall be restricted to designated areas. The developer and property owner shall execute a traffic agreement with the Lemont Police Department that allows the Lemont Police to enforce parking violations on private property. 6. This plan approval assumes the use of public parking lots and parking structures in central locations to satisfy commercial parking demands. Prior to final plan approval, the developer shall submit evidence that sufficient parking exists within 1,000 feet of the subject property to accommodate the planned 14,304 square feet of commercial space. A parking study that documents the availability of public parking within 1,000 feet of the site may be acceptable evidence if available parking totals are sufficient to absorb 14,304 square feet of retail space. The Village may waive the parking study requirement if an additional 53 public parking spaces [14,305 square feet x 4.5 spaces/1, 000 square feet —11 additional on- street spaces = 53 spaces] are provided by others within the 1,000 foot radius of the site. In the event a parking deficit is indicated by study, the developer shall provide on or off- site parking spaces in the amount of the deficit. [note: the 4.5:1,000 square foot ratio is for retail — actual use may include a combination of retail, office- service, and cafe/restaurant uses]. 7. Development shall proceed in the following sequence: Buildings D, A, B & C [Village Board recommendation]. 8. Approval of the site plan and acceptance of the Dlinois & Michigan Canal dedication is subject to verification that the 15'8" path dedication is relatively level and free of obstacles, as indicated on the developer's topographic survey. 9. Prior to final plan approval, a declaration of property owners association including covenants, conditions and restrictions shall be submitted for Village review and approval. 10. Prior to final plat approval, the developer shall make donations to the elementary school district, high school district, and park district as required by the Village of Lemont Land -Cash Ordinance. Summary of findings The ZBA finds that the variations of minimum requirements are justified by the provision of 15,867 square feet (0.364 acres, or 21 percent of site area) of improved public space in the form of public pedestrian ways around the perimeter of the site. The ZBA also finds the residential density of 21.5 du/gross acre is justified by conformance of the site to the B -2 District maximum floor area of 2.5. Actual FAR is 1.17. The Comprehensive Plan classifies the site as "Downtown," a mixed use classification, and Historic District Overlay. As such it does not necessarily have to be bound by the "High Density Residential" limit of 12 du/acre.
