ORDINANCE GRANTING VARIATION IN SIDE YARD SETBACK FROM 15 FEET TO 12.5 FEET IN AN AREA DESCRIBED AS LOT 1 IN THE PROPOSED VICTORIAN ESTATES SUBDIVISION (542 - 546 FIRST STREET) WHEREAS, Sheryl Oremus, hereinafter referred to as "the Petitioner," is the owner of a 3.00 acre parcel, hereinafter referred to as "the subject property," located at 542 -546 First Street in Lemont, Illinois and legally described below; and WHEREAS, Jeff Beyer, hereinafter referred to as "the Applicant," has filed a petition for the subject property with the Village of Lemont for final plat of subdivision referred to as Victorian Estates Subdivision; and WHEREAS, as part of the petition for subdivision, a Variation of a side yard setback from 15 feet to 12.5 feet was filed for the existing house on Lot 1 in the proposed Victorian Estates Subdivision; and WHEREAS, a Public Hearing was held by the Zoning Board of Appeals on June 7, 2004; and WHEREAS, after said Hearing, the Zoning Board of Appeals unanimously recommended to grant said Variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE, that a Variation in the terms of the Lemont Zoning Ordinance is hereby granted for a side yard setback from 15 feet to 12.5 feet to allow a bay structure currently existing and that said Variation is granted to allow the Applicant to obtain Final Subdivision Plat Approval for Victorian Estates Subdivision as described as Exhibit "A ". Section 1: This Variation shall apply to the following described property: The West 119.57 feet of that part of the West '/ of the Northwest 1/4 of Section 28, Township 37 North, Range 11 East of the Third Principal meridian, being described as follows: Commencing at the center of Old Derby Road (now called McCarthy Road) at the East line of the West '/2 of said Northwest 1/4; thence Southerly along said East line 5 chains and 40 links (356.40 feet); thence continuing South along said East line, 231.34 feet to the Point of Beginning, thence continuing South along said East line 389.57 feet; thence Westerly at right angles to last described course, 335.45 feet; thence Northerly parallel to said East line, 389.57 feet; thence Easterly at right angles to said East line, 335.45 feet to the Point ofBeginning containing 3.00 acres in the Township of Lemont, Cook County, Illinois. Also known as proposed Lot 1 in Victorian Estates Subdivision of part of the Northwest 1/4 of the Northeast 1/4 of Section 32, Township 37 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. Commonly known as 542 - 546 First Street, Lemont, Illinois 60439. Section 2: This Variation shall only apply to the bay structure existing on the house located on Lot 1 in the proposed Victorian Estates Subdivision. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
