AN ORDINANCE GRANTING A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT
(PUD) ON A 9.0 ACRE PARCEL, IN THE M -2 DISTRICT (MANUFACTURING DISTRICT), IN
LEMONT, ILLINOIS AT 13065 MAIN STREET KNOWN AS
COG LEMONT INDUSTRIAL COMPLEX
WHEREAS, Peter Burdi with Working Bird, L.L.C., hereinafter referred to as "the Petitioner ", is the
owner of an approximately 9.00 acre parcel, hereinafter referred to as "the subject property ", located at
13065 Main Street in Lemont, Illinois and described in the attached legal description as "Exhibit A "; and
WHEREAS, the Petitioner made application under the provisions of Section X.D.1.b. & XVI.G.1. in
the Lemont Zoning Ordinance for a special use of a PUD to develop an office /warehouse complex with self -
storage units & an outdoor storage area in the M -2 District; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said
Zoning Ordinance, conducted a Public Hearing on the petition on August 2, 2004; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and
was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and
WHEREAS, the Zoning Board of Appeals has recommended approval of the request for a special
use of a PUD to the Village Board; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interests of the Village will be served by approving the Special Use Permit by the standards of the Special
Use Procedures, Sections XVIII. I. of the Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL,
ILLINOIS:
Section 1. Conditions to Special Use. A special use for a PUD is granted to Peter Burdi with
Working Bird, L.L.C., to allow the construction an office /warehouse complex with self - storage units & an
outdoor storage area at 13065 Main Street as described in the attached legal description ( "Exhibit A "), with
the following conditions:
1. Final Plans shall substantially conform to the PUD Preliminary PUD Site/Landscape Plan, prepared
by Matocha Assoc., dated 08.09.04, Architectural Elevation Plans, prepared by Matocha Assoc.,
dated 07.28.04 & 08.09.04, Details Plan, prepared by Matocha Assoc., dated 07.14.04, & Preliminary
Engineering Plan, prepared by Mackie Consultants, revised 08.06.04 attached as "Exhibit B ".
2. Final PUD plans are subject to the Village Engineer's review and approval.
3. A continuous 6' wide sidewalk is required along the frontage of Main Street or cash in lieu of such
improvement due to the lack of a sidewalk network in the area;
4. The main road serving the parcel will be a private road and the two basins exceed the maximum pond
depth up to 6 feet. Both will require a waiver from the Village Board from the Standard
Specifications Manual and the Village Engineer's recommendation on design.
5. A traffic management plan is required. The management plan shall address aisle widths, turning
radii, and on -site directional traffic control signs which is subject to the Village Engineer and Fire
Department's review and approval. Lighting to be orientated face down and to the north to avoid
Department's review and approval. Lighting to be orientated face down and to the north to avoid
glare on adjacent property owners.
6. Truck deliveries are restricted between the hours of 12 a.m. to 6 a.m., daily.
7. Current use (truck container storage) on the property will cease upon approval of first building
permit.
8. The 3 -story building with E.I.F.s or dryvit is required to be built with heavy gauge metal studs as part
of the construction of the building. If the building is reduced to a 2 -story, then pre -cast concrete shall
be required on all four sides of the building.
9. The property owner shall be required to connect to Village water supply and pay the applicable tap on
fees when water main is available. If water main is not available, the use of wells on the site will be
necessary.
10. Cook County permits are required for the two septic systems proposed on the property.
Section 2. A special use for a PUD shall lapse in the event of the following:
a. A complete building permit application has not been received by the Village for such construction,
installation, or relocation within one year after the effective date of the ordinance granting said special
use; or
b. A building permit has been issued within one year of the effective date of the special use, but such
construction, installation or relocation has not commenced within one year after the issuance of the
building permit.
c. In the event a special use lapses, nothing herein shall prohibit any person from applying for the same
special use or a new special use on substantially the same terms."
Section 3. That this ordinance shall be in force and effect from and after its passage, approval
and publication in pamphlet form as provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS, on this 23rd
day of August, 2004.
