AN ORDINANCE AMENDING A SPECIAL USE TO PERMIT THE CONSTRUCTION
OF AN AUTOMOTIVE SERVICE ESTABLISHMENT KNOWN AS JIFFY LUBE AT
15682 W. 127TH STREET IN LEMONT, ILLINOIS
WHEREAS, Preferred Development, Inc., hereinafter referred to as "the Petitioner ", is the contract
purchaser of a parcel, hereinafter referred to as "the subject property", located at 15682 W. 127`h Street in
Lemont, Illinois and described in the attached legal description as "Exhibit A "; and
WHEREAS, the Petitioner made application under the provisions of Section VIII.E.2.n.& t. in the
Lemont Zoning Ordinance for a special use to develop an automotive service establishment; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said
Zoning Ordinance, conducted Public Hearings on the petition on May 6, 2004 & June 7, 2004; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and
was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and
WHEREAS, the Zoning Board of Appeals has not recommended approval of the original request for
a special use to the Village Board; and
WHEREAS, the Village Board approved an Ordinance Granting the Request for A Special Use on
July 12, 2004; and
WHEREAS, the Petitioner now requests permission to amend the plans originally adopted as
exhibits and conditions of approval in the original special use ordinance, specifically to add a "auxiliary
service bay" of no greater than 400 square feet to the building previously approved; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interests of the Village will be served by approving the Special Use Permit, as amended, by the standards of
the Special Use Procedures, Sections XVIII. I. of the Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL,
ILLINOIS:
Section 1. Conditions to Special Use. An amendment of ordinance no. 0 -35 -04 (Jiffy Lube special
use) is granted to Preferred Development, Inc., to allow the construction of an automotive service
establishment at 15682 W. 127th Street as illustrated in the attached Plat of Survey ( "Exhibit B "), with
conditions numbered 1 and 2 below specifically amended to adopt revised plans, as follows:

1. Final Plans shall substantially conform to the plans prepared by Compass Consulting
Group, last revised August 10, 2004, sheets C -1, C -2, C -3, C -4, C -5, C -6, C -7, C -8,
ALTA/ACSM Survey, Landscape Plan, and Photometric Plan, attached as Exhibit "C ";
2. Final Plans shall substantially conform to the Building and Sign Elevations /floor
plan, prepared by Architects 127 +Assoc., revised August 8, 2004, including
ground sign revised 07.12.04 as Exhibit "D ";
3. Hours of operation & lighting (except security lighting) shall be limited from 8 a.m. to 7 p.m.,
Monday thru Friday, 8 a.m. to 6 p.m. on Saturdays and 10 a.m. to 6 p.m. on Sundays;
4. The substitution of "Prairie stone" for split -faced concrete be used for the construction of the building;
5. The owner agrees to cross - access in the rear of the property with adjacent parcels.
Section 2. A special use shall lapse in the event of the following:
a. A complete building permit application has not been received by the Village for such
construction, installation, or relocation within one year after the effective date of the ordinance
granting said special use; or
b. A building permit has been issued within one year of the effective date of the special use, but
such construction, installation or relocation has not commenced within one year after the issuance
of the building permit.
c. In the event a special use lapses, nothing herein shall prohibit any person from applying for the
same special use or a new special use on substantially the same terms."
Section 3. That this ordinance shall be in force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS, on this 23rd
day of August, 2004.

I hope all is well. I have been reviewing the site plan with Preferred Development's design
professionals and the Jiffy Lube operator for the purposes of the easements to the properties to the east
(the KFC /Taco Bell) and the west (the home /contractor's office). As we have discussed, we reduce the
detention area to provide the KFC /Taco Bell easement.
In considering the easement to the west, the one concern that was expressed is traffic from that
development conflicting with the stacking for the Jiffy Lube. Our operator believes he has a solution to
reduce stacking. Please note on the attached site plan that the trash enclosure area originally at the
northeast corner of the building has been replaced with an auxiliary bay. This bay will not be used for
oil changes, but will be used in the following manner: if all bays are occupied and cars are stacked
outside AND one of the costumers already inside the facility requires a service OTHER THAN OIL
CHANGES (most likely transmission or coolant flush — there will be no basement under the auxiliary
bay), a Jiffy Lube porter will pull that vehicle into the auxiliary bay and the vehicle stacking outside will
pull in. This auxiliary bay will be utilized only when vehicles are stacked outside the facility.
To accommodate this auxiliary bay, the masonry trash enclosure shall be moved to the
northwesternmost parking stall. If you recall, the site plan exceeded your code's parking requirements
by 1 stall (we also have discussed that in Jiffy Lube's experience and previous traffic and parking
studies we have conducted, there are rarely more than 3 — 5 cars parked on Jiffy Lube sites.)
We believe that this alternative layout position our site better for future cross access with the property to
the west, by reducing the possibility of stacking. This auxiliary bay will not lead to more traffic or offer
additional services than what the facility already offers.
Please let me know whether this layout works for you both, and whether we have to reappear before the
Village Board to amend the ordinance or to present this slightly changed site plan.
