ORDINANCE NO. r . 0r AN ORDINANCE APPROVING A ZONING VARIATION IN THE FRONT YARD SETBACK FOR THE LENGTH AND HEIGHT OF A FENCE IN THE M -2 MANUFACTURING DISTRICT AT 10800 ROUTE 83 KNOWN AS MENO STONE COMPANY WHEREAS, Massimo Bianchini, hereinafter referred to as "the Petitioner," is acting on the behalf of the owner of a 2.008 acre parcel, hereinafter referred to as "the subject property," located at 10800 Route 83 in Lemont, Illinois and legally described in Exhibit "A "; and WHEREAS, the Petitioner is seeking relief to the Lemont Zoning Ordinance to increase the maximum allowed fence length in the front yard setback from ten (10') feet to two hundred ninety -nine (299') feet, six and three- eighths (6 3/8 ") inches in the M -2 Manufacturing District, pursuant to Section XIV.D.5.b -c of the Zoning Ordinance; and WHEREAS, the Petitioner is seeking relief to the Lemont Zoning Ordinance to increase the maximum allowed fence height in the exterior boundary setbacks from eight (8') feet to nine (9') feet, seven (7 ") inches in the M -2 Manufacturing District, pursuant to Section XIV.F.4 of the Zoning Ordinance; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on September 7, 2004 for zoning variations in the M -2 Manufacturing District; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter/Met a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public hearing as required by law, approved variations in the M -2 Manufacturing District to increase fence height and length in the exterior boundary yards; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the variations as described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Section 1: Front Yard Setback Maximum Fence Length: A variation is granted to the maximum fence length required in the front yard setback in a M -2 Manufacturing District from ten (10') feet to two hundred ninety -nine (299') feet, six and three- eighths (6 3/8 ") inches, pursuant to Section XIV.D.5.b -c of the Lemont Zoning Ordinance to construct a decorative steel and masonry fence as shown in Exhibit `B ". Section 2: Front Yard Setback Maximum Fence Height: A variation is granted to the maximum fence height required in a M -2 Manufacturing District from eight (8') feet to nine (9') feet, seven (7 ") inches, pursuant to Section XIV.F.4 of the Lemont Zoning Ordinance to construct a decorative steel and masonry fence as shown in Exhibit `B ". Section 3: Condition of Approval: The above variations shall be approved subject to the petitioner obtaining building permits within one year of the effective date of this ordinance or the variations shall be null and void.
