O-67-04 10/11/04VILLAGE OF LEMONT ORDINANCE NO. p-- 67-o -f AN ORDINANCE AMENDING ORDINANCE NO. 871 APPROVING A RESIDENTIAL PLANNED UNIT DEVELOPMENT (R -5 PUD) ON THE FRANCISCAN SISTERS OF CHICAGO PROPERTY TO INCLUDE 1.5 ACRES TO CONSTRUCT A SATELLITE FIRE STATION FOR THE LEMONT FIRE PROTECTION DISTRICT LOCATED AT 11520 WALKER ROAD (FRANCISCAN SISTERS OF CHICAGO/LEMONT FIRE PROTECTION DISTRICT, SATELLITE FIRE STATION #4) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 11th DAY OF OCTOBER, 2004 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Cook, DuPage, and Will Counties, Illinois this 11th day of October, 2004. c�- V1 —oy AN ORDINANCE AMENDING ORDINANCE NO. 871 APPROVING A RESIDENTIAL PLANNED UNIT DEVELOPMENT (R -5 PUD) ON THE FRANCISCAN SISTERS OF CHICAGO PROPERTY TO INCLUDE 1.5 ACRES TO CONSTRUCT A SATELLITE FIRE STATION FOR THE LEMONT FIRE PROTECTION DISTRICT LOCATED AT 11520 WALKER ROAD WHEREAS, Franciscan Sisters of Chicago, hereinafter referred to as "the Property Owner ", are the owners of approximately 1.5 acres, hereinafter referred to as "the subject property", PIN #22 -21- 401 -011, in Lemont, Illinois; said parcel is legally described in "Exhibit A" attached to this Ordinance; and WHEREAS, Lemont Fire Protection District, hereinafter referred to as "Petitioner ", has executed a successful lease agreement with the property owner to construct a satellite fire station on the subject property; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a residential planned unit development to rezone the parcel to R -5 PUD Zoning (Single - Family Attached Residence District, Planned Unit Development) from Cook County R -4 Zoning (Single Family Residence District), pursuant under Sections XVI and XVIII. I. and J. WHEREAS, the petitioner has prepared a Preliminary PUD Plans in the form of a site plan, landscape plan, photometric plan & engineering plan for the satellite fire station; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on September 7, 2004; and WHEREAS, the Zoning Board of Appeals made a positive recommendation for said PUD by a vote of 6 -0; and WHEREAS, the petitioner has submitted the Preliminary PUD Plans for the satellite fire station, attached hereto as "Exhibit B "; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village of Lemont have determined the proposed PUD plan to be in the best interest of the Village of Lemont. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Conditions of Approval. That the satellite fire station preliminary PUD plans, (attached at "Exhibit B "), are hereby approved with the following conditions: Section 1. A zoning map amendment is granted to allow the change in the zoning classification of the parcel located at 11520 Walker Road to R -5 PUD Zoning (Single - Family Attached Residence District, Planned Unit Development) from Cook County R -4 Zoning (Single Family Residence District), as illustrated in the Plat of Survey attached as Exhibit "A ". Section 2. As provided in Chapter XVI.I. Conditions to the Special Use — Planned Unit Development for Lemont Fire Protection District. a. The Lemont Fire Protection District will be required to construct a 5' wide sidewalk when a sidewalk network exists on the west side of Walker Road, adjacent to subject property. b. Construction shall substantially conform to the following plans and exhibits, created & submitted by Wight & Company: (1) Site Plan (Sheet EX1.00), dated 06.15.04; and (2) Tree Preservation Plan (Sheets L1.1, L2.1, L2.2), dated 08.04.04; and (3) Elevation Plan, dated 08.25.04; and (4) Floor Plan, dated 08.25.04; and (5) Photometric Plan, dated 08.25.04; and (6) Light Details (DMS50 /60 series) by Lumec. c. Changeable Copy or LED Sign will be required to comply with sign regulations at the time a Sign Committee has been established. d. Not withstanding Ordinance #871, no further expansions of the Franciscan Sisters of Chicago property shall be permitted without further amendment to the PUD. Section 3. The Planned Unit Development approval shall lapse in the event the Petitioner does not file a complete application for a site development permit within one (1) year of the effective date of this ORDINANCE.
