O-74-04 10/25/04ORDINANCE — 7 V - (2 ORDINANCE CREATING THE ART & CULTURE COMMISSION NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that: SECTION 1: Chapter 2.69 of the Lemont Municipal Code is hereby created: ART & CULTURE COMMISSION 2.69.010 TITLE. The name of this organization is known and cited as the "Village of Lemont Art &Culture Commission." 2.69.020 PURPOSE OF COMMISSION The Lemont Art & Culture Commission's charge is promote the artistic and cultural life of the Village through the initiation, evaluation, selection, creation and promotion of visual arts (sculpture, murals) and performing arts (music, dance) projects. Such projects not only contribute to the quality of the cultural life but also stand to benefit the community's economic life as well. The Commission provides a channel of communication between Village government and the business owners, students, teachers, artists and residents motivated by interest in the visual and performing arts. 2.69.030 MISSION. The Art & Culture Commission was established by the Village Board to enrich the lives of Lemont's residents and visitors by cultivating and promoting the appreciation of our heritage through public arts projects. 2.69.040 RESPONSIBILITIES AND POWERS. The Commission shall have the following responsibilities and powers under this subchapter: A. Partner with community groups, taxing bodies, corporations and individual sponsors to facilitate public art projects and assist the Village in these activities. B. Educate and empower the community through public art. C. Generate interest, excitement, and cultural tourism. D. Form partnerships with artists, architects, developers, local authorities and the community at large to promote art experiences that beautify the region while offering historical learning opportunities, which also enhance economic opportunities. E. Initiate projects that encourage quality and innovation in concept, context and material realization. 2.69.050 COMPOSITION; OFFICERS AND DUTIES; COMMISSIONS; MEETINGS. (A) Composition. All Commission members are appointed by the Mayor with the concurrence of the Board of Trustees. Appointments are for terms of two years, each of which expire on April 30th (1) Voting members. The Executive Committee is composed of 5 official members, each with an equal vote. (2) Any member may be appointed to successive terms on the standing Commission. Appointments for vacancies are filled by the Mayor with the concurrence of the Board of Trustees, but only for the balance of the term created by the vacancy. (3) The Mayor, with the concurrence of the Village Board of Trustees, may for good cause shown remove any member of the standing Commission. (B) Officers and duties. The officers and duties are determined by the Village Board. (1) Chairman. The Commission Chair shall be a voting member of the Commission. The Chair shall preside over all meetings of the Commission. (2) Vice - Chairman. In the absence of the Chair the Vice - Chairman shall assume his /her duties. (3) Secretary. The Secretary shall maintain a record of all meetings, attendance, and other items as deemed necessary, and shall perform those functions as determined by the Chair. (C) Meetings. The Commission shall meet as frequently as its rules of procedure shall provide, but not less than once every three months. All members of the Commission are required to attend all regularly scheduled meetings. Any member who is absent from three (3) consecutive meetings in any one calendar year, without being excused by the Chair or his /her designee, shall be recommended to the Village President and Board of Trustees for removal from the Commission. (1) Regular meetings - Regular meetings of the Commission shall be held at such other location as designated by the Chair at the prior meeting. (2) Quorum - A quorum of the Commission shall be comprised of the majority of the voting membership on the Commission. A quorum of the Commission must be present when voting. Passage of any motion shall require a simple majority of the quorum so voting. (3) Meeting procedures - The Commission shall adopt Robert's Rules of Order, current edition. 2.69.060 AMENDMENTS. (A) These "by- laws" within this subchapter may be recommended for amendment to the Village Board by a majority vote of the members present and voting at the next scheduled meeting at which amendment was formally proposed. All Commission members shall be notified by mail of the proposed amendment at least ten days prior to the meeting at which the final vote of the amendment shall be called. (B) A recommendation upon the amendment in a report format shall be forwarded to the Village President and Board of Trustees within 30 days for final adoption under a resolution. SECTION 2: Effective Date: This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. SECTION 3: Repealer: All Ordinances or parts of Ordinances in conflict herewith shall be and the same are hereby repealed. The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and cause the same to be published in pamphlet form.
