RESIDENTIAL PLANNED UNIT DEVELOPMENT (PUD) ON AN 8.5 ACRE
PARCEL(S), LOCATED WEST OF RUFFLED FEATHERS SUBDIVISON AT 14407 &
14423 W. 131ST STREET AND REZONING FROM COOK COUNTY R -3 ZONING
(SINGLE FAMILY RESIDENCE DISTRICT) TO R -4 PUD (SINGLE FAMILY
DETACHED RESIDENCE DISTRICT, PLANNED UNIT DEVELOPMENT) IN
LEMONT, ILLINOIS

WHEREAS, Andrzej Benarczyk with All Pro Development, Inc., hereinafter referred to as "the
Petitioner ", are the owners of approximately 8.5 acres, hereinafter referred to as "the subject property", PIN
#22 -33 -203 & 22 -33- 203 -024, in Lemont, Illinois; said parcel is legally described in "Exhibit A" attached to
this Ordinance; and
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance
for a residential planned unit development to rezone the parcel to R -4 PUD Zoning (Single Family Detached
Residence Planned Unit Development) from Cook County R -3 Zoning (Single Family Residence District),
pursuant under Sections XVI and XVIII I and J.
WHEREAS, the Plan Commission met on April 13, 2004 and has recommended approval of the
request for a single family detached residential plan unit development (R -4 PUD) to the Village Board; and
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with
said Zoning Ordinance, conducted Public Hearings on the petition on May 3, 2004, and June 7, 2004 and has
denied the recommendation for said PUD by a vote of 5 -0 with two absent to the Village Board;
WHEREAS, subsequent to the decision of the Zoning Board of Appeals, the petitioner revised the
preliminary PUD plan to increase the size of the detention basin, reduce density and increase overall lot sizes
which has been included on the attached exhibits; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and
was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of
Lemont, that the Petitioner, Andrzej Benarczyk with All Pro Development, Inc., be granted the requested
single family detached residential plan unit development zoning (R -4 PUD) from Cook County R-3 Zoning
(Single Family Residence District).
Section 1. A zoning map amendment is granted to allow the change in the zoning classification of the
parcel located west of Ruffled Feathers Subdivision on 1315E Street to R -4 PUD Zoning (Single Family
Detached Residence Planned Unit Development) from Cook County R -3 Zoning (Single Family Residence
District), as illustrated in the Plat of Survey attached as Exhibit "C ".
Section 2. As provided in Chapter XVI.H.1. &3. (Special Use — Planned Unit Developments) of the
Lemont Zoning Ordinance, the Village has deemed it appropriate to approve the following selected bulk exceptions
as part of the Planned Unit Development for Meadow Lark Subdivision, Phase I.
a. Zoning variations to reduce the front and side yard setbacks for the two existing homes as
shown on Lots 8 & 10 of the Preliminary Subdivision Plat, prepared by Geopool Surveyors,
Inc. and dated 08/09/04 attached hereto and incorporated herein as Exhibit "B" of this
Agreement. Additions, alterations or new construction shall comply with the then- current
setbacks in the Lemont Zoning Ordinance.
Section 3. The Planned Unit Development approval shall lapse in the event the Petitioner does not
file a complete application for a site development permit within one (1) year of the effective date of this
AGREEMENT.

VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS, on this 25th
day of October, 2004.
