AN ORDINANCE GRANTING THE REQUEST FOR REZONING AT 14243 MC
CARTHY ROAD FROM COOK COUNTY R -3 ZONING (SINGLE FAMILY
RESIDENCE DISTRICT) TO R -3 ZONING (SINGLE FAMILY RESIDENCE) IN
LEMONT, ILLINOIS
WHEREAS, Paul and Mary Kulaga, hereinafter referred to as "the Petitioners ", are the
owners of a 1.05 acre parcel, hereinafter referred to as "the subject property ", located at 14243
McCarthy Road, in Lemont, Illinois.
WHEREAS, the Petitioners made application under the provisions of the Lemont Zoning
Ordinance for the rezoning of the parcel in question to R -2 Zoning (Single Family Residence
District) from Cook County R -4 Zoning (Single Family Residence District), pursuant under
Section IXIII J.
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in
accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on
September 21, 2004;
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided
by law and was published in the Lemont Reporter Met, a newspaper of general circulation within
the Village; and
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of
the Village of Lemont, that;
Section 1: The Petitioners, Paul and Mary Kulaga, be granted the requested rezoning to
R -3 Single Family Residence District from Cook County R -3 Single Family Residence District,
as illustrated in the Plat of Survey attached as Exhibit "A ";
Section 2: The owners shall be permitted to maintain the existing detached garage as a
legal non - conforming structure in accordance with Section XVII of the Zoning Ordinance;
Section 3: Notwithstanding their connection of new dwelling construction to Village
water system, the owners shall be permitted to maintain the existing private water supply well on
the property for irrigation purposes until the well requires replacement, subject to Section 13.12
of the Lemont Municipal Code (Cross - Connection Control and Backflow).

OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE,
