ORDINANCE NO 79 3 67V' AN ORDINANCE GRANTING A SPECIAL USE PERMIT AT 604 -06 STATE STREET IN LEMONT, ILLINOIS WHEREAS, Emerald Home Builders, as beneficiary of State Bank of Countryside Trust #04 -2657, hereinafter referred to as "the Petitioner ", is the owner of a parcel, hereinafter referred to as "the subject property", located at 604 -06 State Street in Lemont, Illinois and described in the attached legal description as "Exhibit A "; and WHEREAS, the Petitioner made application under the provisions of Section XVIII. I. in the Lemont Zoning Ordinance for a Special Use Permit to operate a mortgage broker/ professional office in a residence district; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted Public Hearings on the petition on December 7, 2004; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and WHEREAS, the Zoning Board of Appeals recommended approval of the request for a Special Use Permit to the Village Board; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit by the standards of the Special Use Procedures, Sections XVIII. I. of the Zoning Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: Section 1. Conditions to Special Use. A Special Use Permit is granted to the Petitioner to allow mortgage broker /professional offices (Loangistics Mortgage Solutions) as a "unique use" in the R -4 Single - family Residence District, subject to the following conditions: 1. The use of 606 State Street shall be limited to business and professional office only; the use of 604 State Street shall be limited to single - family residence only. 2. Business hours of operation shall be restricted to between 7:00 am and 10:00 pm daily. 3. Use of the 13 -space parking lot may be shared with St. Alphonsus Parish on Sundays. 4. Signs shall be limited to one wall sign on the north side of the 606 State Street building and shall not exceed 73 inches by 36 inches (existing sign cabinet). No sign displays whatsoever shall be permitted on the south side of the building due to the minimal setback from the side property line. 5. The building shall remain legal non - conforming with respect to zoning bulk and development regulations. No expansion of the building and uses shall be permitted without amendment of this special use. Section 2 That this ordinance shall be in force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
