A 6)6) DATE OF APPROVAL A - a t 00 RESOLUTION APPROVING A 1" UTILITY EXTENSION HARDSHIP FOR PROPERTY ON WALTER STREET WHEREAS, the Village of Lemont has received a request for a hardship case for the owner of property located at Walter & Peiffer Streets which is legally described in Exhibit "A" attached; and WHEREAS, the owner of the property , after he purchased the property, was informed of the significant expense of extending a water main to the property; and WHEREAS, the Owner is seeking approval for a Utility Extension Hardship. NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont that the request for a Utility Extension Hardship is hereby granted.. Each use hereafter established which requires sewerage and water facilities shall be served by public or community sewerage and water systems, except as hereinafter provided. Utility Extension Hardship. Lots one acre or more in area, in areas that are not served with public sewerage or water systems may be served with individual sewage disposal systems or private wells, provided the Village Board shall (a) find, after receiving the recommendation of the Community Development Director and Village Engineer, that is impracticable to extend public or community sewer or water lines to serve the area, and (b) there is an irrevocable commitment by the owner of the lot that connections shall be made to a public or community sewerage or water system not more than one (1) year after such system has been installed or extended to serve the lot. 3. Private System Standards. Installation of individual sewage disposal systems and private wells or community sewerage and water systems shall be in accordance with standards and specifications set forth in applicable laws of the Village, County, and State. 4. Lot/Area Standards. A lot that was not a lot of record on the effective date of this ordinance, which is to be used for a single - family detached dwelling served with an individual sewerage disposal system shall have an area of not less than one acre and a width of not less than 150 feet or a greater area or width if required to conform with regulations contained in this Section. 5. Newly Annexed Areas. In the case of newly annexed areas, the Village Board may waive the requirement of connecting to public utilities for a set time as stated in the annexation agreement, or may waive such requirements only until the municipal water and sewer services are provided to the area, provided, however, that there is an irrevocable commitment by the owner(s) that the connections shall be made to a public or community sewerage and water system not less than one (1) year after such system has installed or extended to within 100 feet of the property line. EXHIBIT 1 Smagacz Hardship 4621 W. 1011' Street Oak Lawn, IL 60453 February 2, 2000 Mr. Andy Fitz 418 Main Street Lemont, IL 60439 Dear Mr. Fitz, This letter is submitted to your requesting a hardship case in front of the Village Planning Committee. We are seeking the approval of running a 1" water line from Peiffer to our property location on Walter Street or digging a well. On January 10, 2000 I met with John Fincham and he informed me that I would be responsible to run a 6" water line from Peiffer to the northern most part of my property and to speak to Jim Cainkar for specifics. On January 18, 2000 I spoke with Jim Cainkar and he informed me that an 8" main duct and an EPA permit would be needed. We made some phone calls for general estimates on this project and are currently compiling hard copy estimates. It seems that the cost to us would be 17,000 plus. We are also concerned about damage that will be done to two mature oak trees and the cost to remove them. The cost of this water line will make it impossible for us to afford to build on this property. My wife and I would appreciate a speedy response to this request for we planned to submit our house plans to the Village of Lemont by mid February and plan to break ground on April 1, 2000.
