MINIMUM YARD 1. Front yard. Not less than twenty -five (25) feet. Where a front yard is across an existing or proposed right -of -way from a Residence District, the front yard shall be not less than forty (40) feet. 70 2. Side yards. a. On an interior lot, two (2) interior side yards, each of which shall be not less than fifteen (15) feet. b. On a corner lot, one interior side yard which shall be not less than fifteen (15) feet in depth and one corner side yard which shall be not less than twenty -five (25) feet in depth. 3. Rear yard. Not less than twenty -five (25) feet. 4. Transitional yards. Collective Provisions Off - street parking facilities for separate uses may be provided, upon approval by the Planning and Zoning Commission and Village Board, collectively if the total number of spaces so provided is not less than the sum of the separate requirements for each such use and provided that all regulations governing location of accessory parking spaces, in relation to the use served, are adhered to. 9. Design and Maintenance a. Open and Enclosed Spaces Accessory off - street parking spaces located on the same lot as occupied by the use served may open to the sky or enclosed in a building. Accessory off - street parking spaces that may be permitted elsewhere than on the same lot occupied by the use shall be open to the sky, except when an off -site storage garage or parking structure is recommended by the Planning & Zoning Commission and authorized by the Village Board. b. Surfacing & Striping All open off - street parking areas shall be paved with either asphalt or concrete according to specifications approved by the Village Engineer. All parking spaces shall be permanently striped to delineate location. Curbs and Wheel Stops All open off - street parking areas except those accessory to single - family dwellings shall be improved with protective curbs and or wheel stops. Spaces which meet directly front to front do not need curbs or wheel stops. d. Screening and Landscaping All open off - street parking areas containing more than four parking spaces shall be landscaped in accordance with the landscaping and screening requirements of this ordinance. 101 d. PROHIBITED FENCES No dangerous or hazardous type fence such as barbed wire, electrical fences, fences with spikes, glass, or other sharp points imbedded in them, or any other type fence that could result in injuries to persons climbing on or over such fences, shall be permitted to exist, be erected, or maintained within the Village of Lemont, with the exception of fences in the Manufacturing Districts, barbed wire may be installed as outlined in Section XIV -F. PERMIT REQUIRED No person shall build, install, erect, reconstruct, replace, alter, enlarge, or extend a fence or part hereof, without obtaining in advance a permit therefore and paving a fcc of twenty -five dollars ($25.00). the applicable fee. An application under this section shall be made to the Village Building Department and shall include a sketch plan describing the proposed fence and showing, to extent necessary to establish compliance with the requirements of this Ordinance, its Location in relation to (I) the lot lines of the lot on which the fence is placed, (ii) any structures on said lot, and (iii) depicting any proposed grade changes in said area. All applications shall be made to the Building Department and shall include a sketch showing the type of fence to be constructed and its location. If property line locations are in doubt, then a registered survey should be provided. A permit is not required for routine maintenance of a conforming or legally nonconforming fence as permitted under Section XIV D. GENERAL PROVISIONS 1 Construction Standards All fences shall be built, installed, erected, reconstructed, restored, replaced, altered, or extended in a workmanlike manner. All fences shall be securely anchored in the ground. All fences must be installed so that the finished side faces away from the lot on which it is erected. All posts must face the interior of the lot on which erected. BUILDING, PRINCIPAL: A non - accessory building in which is conducted the principal use of the lot. CANOPY /MARQUEE: A non - retractable structure on a framework sheltering an area or forming a sheltered walk to the entrance of a building. CARPORT: A roofed automobile shelter, with two or more open sides. CELLAR: An arca having morc than one -13alf of its floor to clear ceiling height below grade and which is not counted as a story. CLINIC, MEDICAL OR DENTAL: A building or portion thereof, the principal use of which is for offices of physicians or dentists or both, for the examination 226 SIGN, WALL: A sign which is affixed to an exterior wall of any building, and shall project no more than 12 inches from the building wall or parts thereof. SIGN, WINDOW: Any sign painted or applied to window glass or within twelve (12) inches of the glass line. SMOKE: The visible discharge from a chimney, stack, vent, exhaust, or combustion process which is made up of particulate matter. SMOKE UNIT: The number obtained when the smoke density in the Ringelmann Number is multiplied by the time of emission in minutes. For the purpose of this calculation: (a) a Ringelmann density reading shall be made at least once a minute during the period of observation; (b) each reading is then multiplied by the time in minutes during which it is observed; and (c) the various products are then added together to give the total number of "smoke units" observed during the entire observation period. The Commission heard testimony from the Village Planner. The Commissioners felt that a majority of the proposed amendments are really more of a `housekeeping" measure, due to the fact that many of them involve errors in syntax or unnecessary duplication. The one revision that the Commissioner's felt strongly about was the need to reexamine the regulations governing the parking of commercial vehicles in residential districts. The Commissioner's as a whole felt that more restrictive regulations should be adopted, as it is a matter of protecting property values and separating incompatible uses. Following a careful review, the Planning and Zoning Commission's vote to recommend approval of the amendments passed by a vote of 6 -0. Staff has been unable to secure the recommendations from the Lemont Advisory Environmental Commission, and therefore no changes are proposed for the Industrial Performance Standards at this time. Many of the proposed amendments are to correct minor errors in syntax or duplication. However, a number of the proposed amendments are being recommended due to problems that have been encountered in the daily administration of the ordinance. Due to the need to examine each item individually with the Commission and the Village Board, a detailed analysis of each amendment has not been included in this report. The proposed changes are highlighted on the attached exhibits with text deletions indicated as a strike- through, and text additions indicated in bold text. STAFF RECOMMENDATION The Staff's Recommendation may be based on the following elements and considerations: the Comprehensive plan, Illinois Zoning and Planning Statutes, Case Law, the Zoning Ordinance, other applicable village ordinances, input from various village departments and personnel, and professional expertise and knowledge of urban planning practices and principles. It has not incorporated public and/or expert testimony or new and better information presented during public hearings/proceedings on the petition. The Staffs Recommendation is subject to change and modification and should not be construed to be fmal and irrevocable. Staff recommends approval of the proposed text amendments.
