ORDINANCE GRANTING A VARIANCE
TO THE LEMONT SUBDIVISION ORDINANCE
( Archer Avenue and Derby Road, Lemont, Dlinois)
WHEREAS, an application has been filed by Ed Resner of Eddy/Resner Engineering,
representing KinderCare Learning Centers, and in connection with a request for a variance for
property legally described in Exhibit "A" and located at Archer Avenue and Derby Road in Lemont,
Illinois; and
WHEREAS, the applicant is seeking a variance from the Lemont Subdivision Ordinance;
and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in
accordance with said Subdivision Ordinance, conducted a Public Hearing on the petition on March
7, 2000; and
WHEREAS, the Lemont Planning and Zoning Commission has recommended approval of
the variance to the Village Board; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interest of the Village will be served by the approval of the requested variance.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Variance
1. Variance from the Subdivision Design Standards for Stormwater Detention: Section
7.02 -4: "The required detention pond volume shall be equal to 1.25 times the peak volume
calculated from the Modified Rational Formula ".
SECTION 2: Conditions of Approval
The Variance shall be subject to the following conditions:
1) Development of the site shall substantially conform to the site and engineering plans
attached as Exhibits B & C;
2) The 50 -foot shared ingress/egress easement shall be realigned to correspond with the
existing location of the shared drives and entrances;
3) A plat of consolidation shall be prepared which consolidates the two KinderCare
parcels into a single parcel;
4) The Community Development Department Staff will work with KinderCare to
encourage the installation of a wrought -iron type fence rather than the proposed
chainlink fence with vinyl coating;
5) The Community Development Department Staff will work with KinderCare to
develop the site in such a way as to maximize tree preservation - particularly the trees
that are currently along the perimeter of the subject property;and
6) A future change in use of the site shall precipitate a re- evaluation of the on -site
detention that is being provided - with the intent of increasing it to meet Village
Standards.
