ORDINANCE APPROVING AN AMENDMENT
TO A PLANNED UNIT DEVELOPMENT KNOWN AS
KENSINGTON ESTATES

WHEREAS, Edward Mansell, hereinafter referred to as "the Petitioner", is the owner of an
approximately 27.4 acre parcel, hereinafter referred to as "the subject property", located along
McCarthy Road & Steeples Drive, directly abutting the Mt. Vernon Cemetery to the north and legally
described in Exhibit "A "; and
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning
Ordinance for a residential Planned Unit Development to be known as KENSINGTON ESTATES;
and
WHEREAS, the Planning Commission of the Village of Lemont, Illinois (the "Village ") did
heretofore commence and conduct a Public Hearing on May 18, 1999 and recommended approval
of a Planned Unit Development known as KENSINGTON ESTATES; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by
law and was published in the Lemont Metropolitan, a newspaper of general circulation within the
Village; and
WHEREAS, the Lemont Planning Commission has recommended the adoption of a Planned
Unit Development Ordinance by the Board of Trustees of the Village; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interests of the Village will be served by the adoption of the Planning Commission recommendations
specified below regarding the subject property; and
WHEREAS, the President and Board of Trustees of the Village approved the development
of the subject property as a Planned Unit Development pursuant to Ill.Rev.Stat.Ch.24, 11- 13 -1.1.

WHEREAS, the President and Board of Trustees of the Village of Lemont adopted
Ordinance 0 -70 -99 on August 23, 1999, approving the KENSINGTON ESTATES Planned Unit
Development; and
WHEREAS, the Petitioner made application to amend the Planned Unit Development; and
WHEREAS, the proposed amendment would authorize the addition of a 5 acre parcel for
the development of an additional 10 lot single family residential lots; and
WHEREAS, the Lemont Planning & Zoning Commission conducted a Public Hearing on
April 4, 2000 after publication of appropriate notices; and
WHEREAS, the Lemont Planning & Zoning Commission recommended approval of the
proposed amendment.
NOW, THEREFORE, BE IT ORDAINED BY 111li PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:
SECTION 1: Planned Unit Development Amendment. That a Planned Unit Development
be amended and approved to allow the Petitioner to construct an additional 10 single - family homes
upon the subject property legally described in Exhibit "A "pursuant to Owner's Preliminary Plans
attached hereto as Exhibit B and subject to the following conditions:
1) The Final Plat shall comply substantially with the revised preliminary plans, attached as exhibit
"B ", and shall be submitted with the following additions/corrections:
a) the platted 10 -foot strip extending from the Cambridge Way cul -de -sac to Outlot "C ",
shall be replaced with a 10 -foot utility easement that shall be granted to that specific
lot;
b) a 20 -foot no- access or conservation easement shall be delineated on the plat along the
yards of lots 16 & 17 abutting McCarthy Road; and
2) Specifications and elevations for any proposed fencing shall be submitted for compliance with
current Village codes;
3) Outlot "B" shall be owned and maintained by the Kensington Estates homeowner's
association; and
4) The 10 -foot strip denoted as Outlot "G ", shall be changed to a conservation easement where
it abuts the rear lot line of lot 56;

5) If after further analysis it is determined by Staff that the row of trees along both sides of St.
James Way are required to be replaced due to their poor condition or for safety reasons, the
petitioner shall be responsible for their replacement; and
6) The stockade fence that is proposed along the perimeter of the approximate 6 acre
unincorporated acreage along McCarthy, shall be incorporated into the covenants and
restrictions as the responsibility of the homeowner's association to maintain.
SECTION 2: Zoning District Change. The subject property described above be and the
same is hereby rezoned from its present R-1 Single - family Residence District Zoning Classification
to PUD with an underlying zoning of R -5 Single - family Residential on approximately 5 acres legally
described in Exhibit "A ".
