AN ORDINANCE APPROVING A SPECIAL USE
IN THE B -3 DISTRICT
( 700 Main Street, Lemont, Illinois)
WHEREAS, an application has been filed by Stan B. Tomala, duly authorized agent for John
Grele, in connection with a Request for Special Use for the property legally described in Exhibit "A"
and located at 700 Main Street, Lemont, Illinois; and
WHEREAS, the Petitioner made application under the provisions of Lemont Zoning
Ordinance 0- 26 -99, for a request for a Special Use to permit 2 dwelling units as a Unique Use in the
B -3 District, pursuant to Section VIII.E.2.u. of the Lemont Zoning Ordinance; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by
law and was published in the Lemont Metropolitan, a newspaper of general circulation within the
Village; and
WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the
"Village ") did heretofore commence and conduct a Public Hearing on May 2, 2000 for approval of
a Special Use; and
WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public
hearing as required by law, approved a Special Use Permit; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interests of the Village will be served by approving the Special Use Permit described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND
WILL, ILLINOIS:
SECTION 1: Special Use. The subject property described above is hereby permitted
2 dwelling units as a Unique Use in a B -3 Arterial Commercial District, pursuant to
Section VIII.E.2.u. of the Lemont Zoning Ordinance.
SECTION 2: Conditions. The Special Use is subject to the following conditions:
1) The project shall be built substantially in conformance with the site plan, attached as
exhibit `B ", the building elevations, attached as exhibit "C ", and the floor plan
attached as exhibit "D ";
2) A plat of consolidation shall be prepared by the petitioner, through which the Main
Street frontage shall be dedicated, within 60 days of Village Board Approval;
3) Curb stops shall be installed in the parking lot, and the handicap accessible shall be
relocated closer to the building;
4) Additional landscaping shall be provided, per Staff review and approval, along the
southeast and east property lines; and
5) If a building permit for the addition is not issued within one (1) year from the date of
Village Board approval, the Special Use shall expire.
6) The special use shall be reassessed by the Village within two years of the date of
issuance of a certificate of occupancy for the new addition. If the Village Board
determines at such a time, that usage of the addition has created a parking problem,
they shall have the right to reexamine the petition and impose additional conditions
if necessary; and
7) The building elevations shall be revised to incorporate limestone elements.
