ORDINANCE ENFORCL'NO TRAFFIC CONTROL
ENT RUFFLED FEATHERS SUBDIVISION
WHEREAS, Chapter 625, ILCS, Section 5/11-209.1, empowers local authorities to enforce
the provisions of the Illinois Motor Vehicle Code on private streets and roads, and
WHEREAS, the Management Agent for Ruffled Feathers Property Owners' Association has
filed a written request to enforce the provisions of the Illinois Motor Vehicle Code on all private
streets and roads within the residential development, and
WHEREAS, the Mayor and Board of Trustees of the Village of Lemont are desirous of
granting such requests.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE,
ILLINOIS, AS FOLLOWS:
That all private streets and roads within the Ruffled Feathers Subdivision as set forth and
delineated on a Plat of Subdivision recorded with the Cook County Recorder of Deeds and currently
on file with the Village of Lemont, shall be, and are hereby considered "highways" for enforcement
of the Illinois Motor Vehicle Code and hereby authorize the execution of the attached Agreement
entitled "AGREEMENT REGULATING THE CONTROL OF MOTOR VEHICLE TRAFFIC AND
PARKING IN THE RUFFLED FEATHER SUBDIVISION, VILLAGE OF LEMONT, COOK
COUNTY, ILLINOIS ".
This, ordinance shall be in full force and effect from and after its passage, approval and
publication in the manner provided by law.
All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby
repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this Ordinance and
cause the same to be published in pamphlet form.

AGREEMENT REGULATING THE CONTROL OF MOTOR VEHICLE TRAFFIC AND
PARKING IN THE RUFFLED FEATHERS SUBDIVISION,
VILLAGE OF LEMONT, COOK COUNTY, ILLINOIS
THIS AGREEMENT made and entered into by and between the VII .T.AGE OF LEMONT,
a municipal corporation of the State of lllinois (hereinafter referred to as the "VILLAGE") and THE
RUFFLED FEATHERS PROPERTY OWNERS' ASSOCIATION, an Illinois not - for -profit
corporation, by its duly authorized representatives (hereinafter referred to as the "ASSOCIATION"),
relative tc the private roads and streets in the Ruffled Feathers Subdivision, VILLAGE OF
LEMONT, ILLINOIS.
WITNESSETR:
WHEREAS, Chapter 625, ILCS, Section 5/11- 209.1, authorizes and empowers a municipality
to enter into Agreements to regulate and control motor vehicle traffic and parking on private roads
and streets in subdivisions containing at least ten (10) apartments or single - family residences within
a municipality; and
WHEREAS, the President and Board of Trustees of the VILLAGE deem it necessary for the
health, welfare and safety of persons and its citizens to regulate motor vehicle traffic and parking in
the Ruffled Feathers Subdivision and having been requested by representatives of said subdivision to
regulate motor vehicle traffic and parking on said subdivision's private roads and streets,
NOW, THEREFORE, in consideration of the foregoing and the covenants and agreements
hereinafter contained, to be kept and performed by the parties hereto, it is hereby agreed as follows:
1. The VELAGE hereby agrees to establish by ordinance and enforce existing and future ,

VILLAGE traffic ordinances, enacted pursuant to the Illinois Vehicle Code, I11. %iv, Stat., Chapter
625, Section 1-101, et seq. as the regulations governing the movement of motor vehicle traffic and
the parking of motor vehicles on the private roads and streets of the Ruffled Feathers Subdivision.
2 The ASSOCL4TION does hereby agree to erect and passtall necessary signs, and provide
for all necessary pavement markings, at its own cost and expense, the regulation of motor vehicle
and
parkingt ywithin the movement of traffic upon the private roads and streets of the Ruffled Feathers 3
Subdivision as is necessary to carry out the aforesaid regulations, and do hereby agree to bear the
costs and expense of the maintenance thereof. All signage shall be approved by the VILLAGE and
be in compliance with Illinois Motor Vehicle Code and State Traffic Sign. Standards and shall not be
installed until written approval is obtained from the VILLAGE.

3. At least once each calendar year, the VILLAGE shall inspect said private roads and streets
to verify that all required signs and pavement markings are in place and properly maintained. If the
VILLAGE determines, after said inspection, that additional signs and/or pavement markings are
required, or existing signs and/or pavement markings need to be replaced, the VILLAGE shall also
notify the ASSOCIATION in writing. If the ASSOCIATION fails to take the action required by the
VILLAGE in said notice within forty -five (45) days of the date of mailing said notice, the VILLAGE
may take the necessary actions and bill the ASSOCIATION for the VILLAGE'S costs in relation
thereto, and the ASSOCIATION shall be responsible for the payment of said costs.
4. At least once each calendar year, the VILLAGE shall verify that the ASSOCIATION still
represents the subdivision. It shall be the responsibility of the ASSOCIATION to notify the
VILLAGE of any change of representation relative to the Ruffled Feathers Subdivision. Said notice
shall be given to the VILLAGE within ten (10) days of any such change.
5 It is further agreed that this Agreement shall cover a period of one (1) year f rom the date
hereof and shall be self - renewing for periods of one year each year thereafter, not to exceed a period
of twenty (20) years, unless and until canceled by not less than thirty (30) days written notice by
either party to the other of its intention to cancel the same, in which case the agreement shall
terminate on the thirtieth (30th) day after said notice has been given.
6. Whenever notice is required to be sent to the VILLAGE, it shall be addressed to the
Village Clerk of the VILLAGE OF LEMONT, 418 Main Street, Lemont, Illinois 60439, and
whenever notice is required to be sent to the ASSOCIATION, it shall be addressed as follows:

All notices shall be sent by certified mail, return receipt requested.
7 The ASSOCIATION hereby agrees to indemnify, defend and save whole and harmless
the VILLAGE and its officers, employees and agents from any and all loss or liability and related
expenses (including attorney's fees) of any kind which arise out of, or as a consequence, of the
performance of this Agreement (excluding, however, acts of intentional or willful and wanton
misconduct of police officers and agents of the VILLAGE), The VILLAGE shall be furnished a
Certificate of Insurance indicating the VILLAGE is an additional insured parry under the

ASSOCIATION'S general liability insurance policy and further indicating that said policy wilt not be
canceled without at least thirty (30) days written notice having been given to the VILLAGE.
8. Upon execution of this Ag eement the parties hereto do hereby certify that each has
passed a proper resolutions ordinance authorizing the execution and ratifying the terms and provisions
of the Agreement.
9. Upon the execution of this Agreement, it shall be recorded with the Recorder of Deeds
of Cook County, Illinois.
10. The ASSOCIATION and VILLAGE may contract for such additional reasonable rules
and regulations with respect to traffic and parking in the Subdivision as local conditions may require
for the safety and convenience of the residents and the public or of the users of the parking and
roadway areas.

The Board of Directors of the Ruffled Feathers Property Owners' Association
(hereinafter referred to as the "RFPOA ") hereby RESOLVES that the terms and
provisions of the attached AGREEMENT REGULATING THE CONTROL OF
MOTOR VEHICLE TRAFFIC AND PARKING IN THE RUFFLED
FEATHERS SUBDIVISION, VILLAGE OF LEMONT, COOK COUNTY
ILLINOIS between the VILLAGE OF LEMONT, an Illinois Municipal
Corporation and the RFPOA, an Illinois Not - for -Profit Corporation have been
approved by the RFPOA in accordance with section 10.22 of the
DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS
FOR RUFFLED FEATHERS GOLF ESTATES dated October 7, 1991.
