AN ORDINANCE GRANTING A SPECIAL USE
(JGS Landscaping, 12412 S. Archer Avenue, Lemont, Illinois)
WHEREAS, John and Wynne Schiera of JGS Landscaping Co. Inc., hereinafter referred
to as "the Petitioners," are the owners of the property at 12412 S. Archer Avenue, hereinafter
referred to as "the subject property," and legally described in Exhibit "A ".
WHEREAS, the Petitioners made application for a request for a Special Use to permit
the construction of an outdoor accessory storage yard at 12412 S. Archer Avenue, pursuant to
Section XVIII -I of the Lemont Zoning Ordinance; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided
by law and was published on June 29, 2000 in the Lemont Metropolitan, a newspaper of general
circulation within the Village; and
WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the
"Village ") did heretofore commence and conduct a Public Hearing on July 18, 2000 for approval
of a Special Use; and
WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public
hearing as required by law, approved a Special Use Permit; and
WHEREAS, the President and Board of Trustees of the Village have determined that the
best interests of the Village will be served by approving the Special Use Permit described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND
WILL, ILLINOIS:
SECTION 1: Special Use. The subject property described above is hereby permitted the
construction of an outdoor accessory storage yard in the B -3 District when all conditions
set forth in Section 2 have been completed, pursuant to Section XVIII -I of the Lemont
Zoning Ordinance.
SECTION 2: Conditions. The Special Use is subject to the following conditions:
1. Permits for the storage yard shall not be issued unless construction plans are
consistent with the site plan prepared by JGS Landscape Architects, Inc.,
received on June 26, 2000, and applicable Village ordinances.
2. Storage and parking of construction motor vehicles shall be limited to owner's
motor vehicles and equipment customarily used in the landscape installation
business. No heavy construction equipment including, but not limited to, earth
moving or road building and paving machinery, dump trucks, and hydraulic lifts
may be stored or parked on the site.
3. The owner shall extend water and sewer lines across the frontage of the property
and shall connect the existing office to Village water and sewer systems.
4. A letter of credit shall be required to guarantee required public improvements
prior to issuance of a site development permit.
5. To ensure that it remains an accessory use, the storage yard shall not exceed
8,000 square feet total surface area.
6. Solid screening in the form of a minimum six foot solid fence of commercial
grade cedar or comparable material, and a ten foot buffer with a 100 percent
landscape screening between the fence and adjacent property, consistent with
June 26, 2000 site plan, shall be maintained at all times.
7. An Illinois Department of Transportation permit shall be required for all
improvements in the right -of -way, including access modifications and sidewalk.
8. Residential use shall be prohibited.

permitted on site.
10. No retail sales shall be permitted on site as long as the accessory outdoor storage area
is in use.
11. No exterior vehicle maintenance and repair, other than oil change, shall not be
permitted on site.
