AN ORDNANCE APPROVING SPECIAL USE TO PERMIT NSTALLATION OF A WIRELESS ANTENNA N THE R -4 COMMERCIAL DISTRICT (741 Houston Street, Lemont, Illinois (water tower)) WHEREAS, Voicestream Wireless, hereinafter referred to as "the Petitioner ", is the lessee of an approximately one acre parcel, hereinafter referred to as "the subject property ", located at 741 Houston Street, in Lemont, Illinois and legally described in Exhibit "A "; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance of 1999 (0- 25 -99), for a request for a Special Use to permit installation of a wireless antenna in the R -4 Residential District; and W H N;REAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter/Met, a newspaper of general circulation within the Village; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on November 13, 2000, for approval of a Special Use; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, after a public hearing as required by law, recommended approval of the SpecialUse Permit; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: SECTION 1: Special Use. The subject property described above is hereby permitted a Special Use to install personal communications services (PCS) wireless antenna and related equipment on top of and adjacent to the water tower in the R -4 Residential District. SECTION 1: Conditions. The Special Use is subject to the following conditions: 1. The antenna and equipment area 'shall be constructed to conform to the site plan, attached hereto as Exhibit "B ", and the architectural elevations plan, attached hereto. as Exhibit "C" 2. This special use is contingent upon execution of a lease agreement with the Village Board. If a lease is not executed this Special Use shall be null and void. 3. No interference shall occur between the Voicestream Wireless antenna and any antenna either existing on the water tower or on adjacent properties.
