AN ORDINANCE APPROVING A SPECIAL USE
TO PERMIT THE INSTALLATION OF A WIRELESS ANTENNA
IN THE R -2 COMMERCIAL DISTRICT
WHEREAS, Voicestream Wireless, hereinafter referred to as "the Petitioner ", is the lessee of
an approximately one acre parcel, hereinafter referred to as "the subject property" at 12940 Bell Road
(Lemont Fire Station No. 2, in Lemont, Illinois) and legally described in Exhibit "A "; and
WHEREAS, the Petitioner has made application under the provisions of the Lemont Zoning
Ordinance of 1999 (0- 25 -99), for a request for a Special Use to permit the installation of a wireless
antenna in the R -2 Residential District; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law
and was published in the Lemont Reporter/Met, a newspaper of general circulation within the Village;
and
WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the
"Village ") did heretofore commence and conduct a Public Hearing on November 7th, 2000, for
approval of a Special Use; and
WHEREAS, the Planning & Zoning Commission of the Village of Lemont, after a public
hearing as required by law, recommended approval of the Special Use Permit; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interests of the Village will be served by approving the Special Use Permit described herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL,
ILLINOIS:
SECTION 1: Special Use. The subject property described above is hereby permitted a
Special Use to construct a monopole with wireless antenna and related equipment in the R -2
Residential District.
SECTION 2: Conditions.
a. The installation of the monopole shall require approval of a final site plan by the
Community Development Director that shall completely screen new on- ground equipment
with live landscaping;
b. Approval is contingent upon the review of the site /construction plans by the Village
Engineer and Director of Public Works.
c. Petitioner shall make the monopole available for co- location provided that applicable
standards for the telecommunications industry are met.

CHARACTER OF THE AREA
The subject property is just north of the northwest corner of 131st Street and Bell Road. A portion of the
property is used for an underground pipeline utility. The Cook County Forest Preserve District is located across
Bell Road from this property. Pipeline company and Com Ed rights -of -way are located to the north and west of
this property. The Lemont Fire Protection District station No. 2 is located just to the east of the proposed
antenna site. Vacantiagricultural land is located to the south of this property.
DEVELOPMENT PROPOSAL
Voice Stream PCS, a wireless communications company, seeks approval of a special use to allow placement of
120 -foot monopole tower on a parcel owned by the Lemont Fire Protection District. The monopole would be
constructed to the southwest of the Fire Station (see exhibit 3), on a 40' by 40' leased parcel. Both the Lemont
Police Department and Fire Protection District would co- locate on the pole.
The Village of Lemont Zoning Ordinance classifies "Cellular telephone, telephone exchange and microwave relay
towers" as special uses in the R -2 Single- family Residence District. Panel or radio frequency antennas are similar in
nature and therefore are appropriately classified as special uses. The Planning & Zoning Commission, in keeping with
standards for special uses, may recommend conditions of approval if "deemed necessary to promote the general
objectives of this ordinance and to minimize injury to the value of property in the neighborhood" (Zoning Ordinance,
Section XvIII-I -5)
Wireless communications technology and its related infrastructure continues to grow. The expansion has created a
proliferation of antenna structures in urban areas. While the antenna infrastructure is essential to the function of
wireless communications devices, communities must struggle with the impacts of the structures on the landscape.
One of the strategies for minimizing the visual impact of antennas is "co- location" of antenna mounts on tall
structures. This practice discourages the construction of additional tall structures for single users. The proposed
monopole is in a relatively undeveloped area. Nonetheless, the on- ground equipment should be screened by
appropriate landscaping, as has been required for other pole structures in the Village.
The Federal Communications Commission (FCC), pursuant to the Telecommunications Act of 1996, regulates
antenna operations. Generally speaking, federal regulations pre -empt local land use regulations on these matters.
Local governments may regulate antenna structure aesthetics, location, and impacts on adjacent properties.
PUBLIC RESPONSE
Staff has not received any inquiries regarding the petition
STAFF RECONL ENDATION
The Staff's Recommendation may be based on the following elements and considerations: the Comprehensive plan, Illinois Zoning and
Planning Statutes_ Case Law, the Zoning Ordinance, other applicable village ordinances, input from various village departments and personneL
and professional expertise and knowledge of urban planning practices and principles. It has not incorporated public and/or expert testimony
or new and better information presented during public hearings/proceedings on the petition. The Staff's Recommendation is subject to change
and modification and should not be construed to be final and irrevocable.
Staff recommends approval of the Special Use and Variation, subject to the following conditions:
1) The installation shall require approval of a final site plan by the Community Development Director that shall
completely screen new on- ground equipment with live landscaping;
2) Approval is continent upon the review of the site/construction plans by the Village Engineer and Director of
Public Works.

The meeting of the Lemont Planning & Zoning Commission of the Village
of Lemont was held on Tuesday, November 7, 2000, at the Village Hall.
The meeting was called to order at 7:03 p.m. by Scott Studebaker. The
following Commissioners were present: Katherine Murphy, Ellen Pearson
and Ron Stapleton. Absent: Paul Bruce and Tom Metzger. The following
staff was also present: Andy Fitz, Lisa Friedley and Tim Teddy.
PUBLIC HEARING
A. A motion was made by Ms. Murphy and seconded by Mr. Stapleton to
open the Public Hearing case number 20.19 Voicestream (Lemont Fire
Station). Motion carried 5 -0 by roll call vote.
Mr. Fitz said that the petition is for a Special Use to install a monopole with
antennae and related equipment and a Variance for the pole to be 120
feet instead of the maximum permitted 100 feet at Lemont Fire Station #2
on Bell Road. The property is zoned R -2. The pole will be installed west of
the existing fire station and the Lemont Police Department and Lemont
Fire Department plan to collocate their services with Voicestream. Mr. Fitz
said that the petition has approval from staff with approval of a final site
plan and review of the plans by the Village Engineer and Public Works
Director. The pole will be located on a 40' by 40' leased parcel.
Erwin Lighter, a representative of Voicestream, said that Voicestream
would own the monopole on property owned by the Fire Department. Mr.
Lighter said that the panel antennas connect to the adjoining sites and
form rings for the network. Mr. Lighter handed the Commissioners a color
copy of the cabinet design, which will be screened by landscaping.
Mr. Stapleton asked if AT &T could collocate as well. Mr. Lighter said that
the strength of the pole would allow their equipment, but it would have to
meet AT &T's ring requirements.
Mr. Ptacek asked how many services could collocate. Mr. Lighter said four
to five carriers, including the Fire and Police Departments.
Mr. Ptacek asked why a 120 foot tower is important. Mr. Lighter said that's
what their engineering department determined is needed height -wise to
get to the next ring.
Mr. Studebaker asked why not collocate on the nearby tower. Ms. Matty
said that the Cellular One tower on the pipeline property is too short for
their needs.
Ms. Murphy asked about collocating on the existing tower at the proposed
Montalbano development. Ms. Matty said that they need to locate at the
fire station site for the best service and farthest range. Voicestream is also
interested in forging a relationship with the Fire and Police Departments.
Ms. Murphy would like to see wordage in the ordinance regarding future
collocation.
Mr. Studebaker asked if Voicestream is open to future carriers. Mr. Lighter
said absolutely.
"A provision addressing future collocation will be incorporated into to the
lease agreement" will be added as staff recommendation number 3.
Mr. Studebaker asked if a landscaping plan will be presented to the
Village Board. Mr. Lighter said yes.
Jeanette Daubaras, of 13490 Derby Road, asked if there are guide wires
on the tower. Ms. Matty said no, wires are usually on taller and thinner
towers. The proposed tower is on a concrete base 30 feet deep. Mr.
Lighter said that the tower is built to withstand 80 to 100 mile per hour
winds. Ms. Daubaras asked if there have been any inquiries into the
amount of RF emitted. The Fire Chief said that the equipment is in
compliance with FCC regulations. The Fire Chief said that the Police Chief
is having difficulties with his officers and their walkie talkies in certain
areas. The Fire Chief said that they are happy to see this and the pole will
help police and fire tremendously with public safety.
A motion was made by Ms. Murphy and seconded by Mr. Ptacek to close
the Public Hearing. Motion carried 5 -0.
A motion was made by Ms. Murphy and seconded by Mr. Ptacek to
approve case number 20.19 Voicestream, along with three staff
recommendations. Motion carried 5 -0 by roll call vote.

GENERAL PLANNING DISCUSSION
Mr. Teddy announced that the Planning & Zoning Commission has been
asked by the Lemont Environmental Advisory Commission to attend their
November 16, 2000 meeting.
Ms. Murphy discussed an article on tear downs and suggested that the
Village identify potential areas in the Comprehensive Plan for
redevelopment. Ms. Murphy expressed concern regarding a home that
was torn down in the Blue Hill area and is now being used as a parking lot.
The situation is creating traffic issues and aesthetic concerns and was
never brought before the Commission for review. Staff is aware of the
situation and is trying to contact Father Savorie.
Mr. Teddy said that Montalbano postponed their application on the
Zuschlag property.
