RESOLUTION AUTHORIZING LETTER OF CREDIT REDUCTION
FOR HINDU TEMPLE OF GREATER CHICAGO
WHEREAS, pursuant to the Subdivision Regulations, an owner or developer of a
subdivision is required to deposit certain security or evidence thereof with the Village of
Lemont to guarantee the installation of such improvements; and
WHEREAS, in the matter of the Hindu Temple of Greater Chicago, located at
Lemont and Bluff Roads, Irrevocable Letter of Credit #092400 issued at Mutual Bank in the
amount of $500,000.00 was deposited with the Village of Lemont on April 10, 2000 for the
purpose of guaranteeing the extension of water and sanitary sewer improvements to the
subject property, pursuant to an agreement with Citizens Utility Company; and
WHEREAS, G. L. N. READY has made application for a reduction of the
Irrevocable Letter of Credit #092400 and staff recommends reduction by $450,000.00; and
WHEREAS, a duly authorized agent of the Village of Lemont has inspected certain
portions of the improvement and has found these portions to have been satisfactorily
installed;
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees
of the Village of Lemont that the Irrevocable Letter of Credit #092400 for Hindu Temple of
Greater Chicago is hereby reduced to $50,000.00.

Re: Water and Sewer Supply- Release of Letter of Credit
Dear Mr. Teddy:
We are glad to inform you that as per the wishes of thousands of devotees, the
community center building has been completed. Thc building was started 2 years back
with an estimate of $2.5 million but with all other infra- structure development including
city water and sewer system, the total investment went up to $6 millions. Out of this,
$4.5 million was loan and the rest was from the devotee support. The building was
complete and final walls that with the contractor was done on December 14r" Final
inspection of the building is scheduled for December 20`" with Mr. John Fincham,
Building Commissioner of the Village of Lemont.
The immediate opening of the community center building for public usage is urgently
needed for the following reasons:
I . Since the building is connected with links to both the temples, it helps the
devotees to move around both the temples with out coming out side and face
hardships of the bad weather.
2. The extra revenue generated from the new building will help to service the
interest on the loan (roughly $ 40,000 /month).
3. The new building will help to substitute the existing auditorium facility with age
old audio — visual equipment.
4. In view of the several religious rituals associated with. Hindu Weddings, the local
banquet halls are putting restrictions when they rent their facilities. Hence this
building will help the community to conduct their ceremonies with out any
restrictions.
5. Just like any other major functions, the grand opening of the Community Center
has to he planned at beast 3 months ahead. Also we are planning to invite cultural
artists from India who require additional time to process their visas.

As required by the Village to receive the construction permit, an Irrevocable Letter Of
Credit in favor of Village of Lemont in the amount of 5500,000 was posted to guarantee
the completion of the water and sewer improvements. We are pleased to inform you that
the City Water Supply is connected and on -site sewer construction is also completed.
Due to long lead time for the pumps, all lift station pumps have been ordered. To assure
the completion of the project, temple posted another letter of credit for $ 143,593 with
Citizens Utility . Contractor has also posted a bond for one million dollars to assure the
completion of the project.
Due to the wet land issues for the sewer lift station, the off site sewer lines could not be
completed. To facilitate uninterrupted services at the temples, the on -site sewer lines
were connected to the existing septic detention pond. In this connection we wish to
inform you that we received permit from Illinois EPA for the off -site sewer construction.
We are waiting for the other permit from Du Page Environmental Concerns (DEC) for
the lift station location. The remaining construction of the off -site sewer work shall
begun immediately upon receiving the permit from DEC. For your information, we are
enclosing a) Permit from Illinois EPA, b) Letter of Credit with Village, c) Letter of
Credit with Citizens, e) application with US Army Core of Engineers, d) Agreement with
Citizens Utility.
Due to the outstanding letter of credits, bank is not releasing the much needed funds to
pay the contractors for the completed construction. We believe that we have met all the
requirements mentioned in the letter of credit with the Village for 5500,000. Therefore,
we respectfully request you to release the Irrevocable Letter Of Credit, so that the funds
can be used to pay for the construction. Thank you .

Permit is hereby granted to the above designated permittee(s) to construct and/or operate water pollution control facilities
described as follows (quantities are approximate):
A lift station having 2 pumps with a rated capacity of 420 gpm at 150 feet of TDH, 2,960 feet of 8 inch force main, 305 feet of
service sewer, 2,299 feet of 8 inch sanitary sewer and 13 manholes to serve three (3) non - residential buildings (60 P.E., 6,000
GPD, DAF) located on Lemont Road with discharge to an existing 8 inch sanitary sewer tributary to the above indicated sewage
treatment plant. Permittee to Construct shalt own and operate all service connections,
This Permit is issued subject to the following Special Condition(s). If such Special Conditlon(s) require(s) additional or revised
facilities, satisfactory engineering plan documents must be submitted to this Agency for review and approval for issuance of
a Supplemental Permit.
SPECIAL CONDITION 1: Any connections to this sanitary sewer extension must be in accordance with this permit and the
latest Revisions of Title 35, Subtitle C, Chapter 1. Permits must be obtained if required by said regulations.
SPECIAL CONDITION 2; If this project is located within a wetlands, the U.S. Army Corps of Engineers may require a permit
for construction pursuant to Section 404 of the Clean Water Act
SPECIAL CONDITION 3: The Permittee to Construct shall be responsible for obtaining an NPDES Storm Water Permit prior
to initiating construction if the construction activities associated with this project will result in the disturbance of 5 (five) or more
acres total land area.
An NPDES Storm Water Permit may be obtained by submitting a properly completed Notice of Intent (NOI.) form by certified
mail to the Agency's Division of Water Pollution Control - Permit Section.

Gentlemen:
We hereby establish an Irrevocable Letter of Credit in favor of the Village of Lemont, an
Illinois body politic in the amount of Five Hundred thousand and no /100
(SS00,000.00). This Letter of Credit #092400 will be used to guarantee the completion of
the proposed sanitary, sewer, and water improvements for the property located at 10915
Lemont Road, Lemont, IL a/Wa Hindu Temple of Greater Chicago.
This Letter of Credit shall remain in effect for the period of twelve months from the date
hereof, without regard to any default in payment of money owed to us by the Applicant
and without regard to other claims, which we have against the Applicant.
This Irrevocable Standby Letter of Credit is available to be drawn upon the Village of
Lemont upon presentation, within twelve (12) months from the date hereof, or any
mutually agreed upon extension of that time of a sight draft marked as specified, together
with:
1. Written certification from the Village of Lemont signed by the Commissioner of
Building Department reciting;
a.
b.
That the letter of credit is about to expire and has not been renewed; or
That the contract between Catellus/Citizens Utility has not been executed,
and permits were not received and/or a contract was not awarded by April
3, 2001, or;

c. That the Applicant and the Village of Lemont have failed to reach a
mutual agreement upon the scope, design or construction of the storm
water improvements for the above captioned tots, and the Village of
Lemont has determined that it is necessary for the Village of Lemont to
undertake construction of the required improvements in order to protect
existing property in the arca.
Upon receipt of a written notice from the Applicant that;
a. Contract between CatelluslCitizens Utility has been executed and;
b. Obtained all necessary permits and;
c. Awarded the construction contract to build water /sewer or improvements.
2. Accompanied by written certification of the Village ofLemont signed by thc
Commissioner of the Building Department stating that the requirements have been
completed, the irrevocable credit shall be terminated and no further force or
effects.
This Irrevocable Letter of Credit may be extended from time to time only by thc mutual
agreement of the Village of Lemont and the Applicant.
Our obligation to the Village ofLemont is based solely on the Irrevocable Letter of
Credit engagement between his financial institution and the Village of Lemont and is not
subject to instructions from the Applicant.
This Irrevocable Letter of Credit sets forth in full terms of our undertaking and such
undertaking shall not in anyway be modified, amended, amplified, nor shall it be limited
by referenced to any document, instrument or agreement referred to herein and any such
reference shall flit be deemed to incorporate herein by reference any document,
instrument or agreement.
We hereby certify and agree that all drafts drawn under and in compliance with the terms
of the credit will be duly honored by us on delivery on documents as specified if
presented at this office within the time limits receipt herein. In the event of any dishonor.
we shall specify within forty -eight (48) hours, in writing the reasons or reasons for such
dishonor to the Village ofLemont,
