RESOLUTION APPROVING EASEMENT AGREEMENT FOR STORM SEWER
IMPROVEMENTS WITH WATERFORD COURT OWNERS' ASSOCIATION
WHEREAS, the Village of Lemont is proposing to undertake storm sewer improvements
at Water Court Town Homes , and
WHEREAS, portions of the storm sewer improvements lie on privately owned properties,
with ownership belonging to the Waterford Court Owners' Association; and
WHEREAS, the Village has requested that the owners dedicate a storm sewer easement
for such storm sewer improvements.
NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Trustees that
the attached Easement Agreement with Waterford Court Owners' Association is heselav �,7�88�
approved.

Municipal Corporation, hereinafter
referred to as "Grantee ", and
Waterford Court Owners' Assoc.,
hereinafter referred to as "Grantor ".

WITNESSETH:
WHEREAS, Grantor is willing to grant to the Grantee a perpetual easement subject to the terms,
covenants and conditions hereinafter set forth:
NOW, THEREFORE, in consideration of the mutual promises and undertakings and other good
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Grantor hereby
grants without warranty of title to the Grantee its successors and assigns a perpetual subterranean
easement to the Village of Lemont its successors and assigns, for the full and free right and authority to
install, construct, relocate, replace, inspect, operate, repair and maintain sewer connections, sewer pipes,
manholes, inlets and service connections, and such other appurtenances and facilities as may be necessary
or convenient related to said improvements, in, on, upon, over, through, across and under all of the
"Easement Premises" legally described as:
Lot 17 of Waterford Court Subdivision, being a re- subdivision of Lots 23, 24, 25 and part of
26 in Quarry Ridge Subdivision, being a re- subdivision of Lots 19 and 20 in County Clerk's
Division of Section 29, Township 37 North, Range 11 East of the Third Principal Meridian,
as recorded as documents 93055752 (01/22/1993), 89311831 (07/10/1989), and 269439
(04/30/1880), respectively, in Cook County, Illinois

The Grantor represent and warrant to the Grantee that Grantor is the true and lawful owner of the
described property and has full right and power to grant and convey the rights conveyed herein.
The Grantee hereby agrees to restore all property disturbed by its activities in the use of the
easement to the condition existing prior to the disturbance.
In consideration of the execution and delivery of this Easement, the Grantee hereby indemnifies
and agrees to hold harmless the Grantor from any and all actions, suits, losses, costs, liabilities, and
specifically including, but not limited to damages to property owned by Grantor.
The Grantor shall not construct improvements in the Easement Area or change the finish grade of
the Easement Area without the consent of the Grantee.
This Easement is binding upon and shall insure to the benefit of the heirs, successors, assigns, and
licensees of the parties hereto.
