AN ORDINANCE GRANTING A VARIANCE
TO THE LEMONT ZONING ORDINANCE
(12282 Sumner Street, Lemont, Blinois)
WHEREAS, an application has been filed by Terry Wollums in connection with a Request
for Variation for the property legally described in Exhibit "A" and located at 12282 Sumner Street,
Lemont, Illinois; and
WHEREAS, the applicant is seeking relief to the Lemont Zoning Ordinance , pursuant to
Section VII.F.7. General Provisions, to allow the construction of a townhome unit, as indicated on
Exhibit `B "; and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in
accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on December
5, 2000; and
WHEREAS, a notice of the aforesaid Public Hearing was made m the manner provided by
law and was published in the Lemont Metropolitan, a newspaper of general circulation within the
Village; and
WHEREAS, the Lemont Planning and Zoning Commission has recommended approval of
the variation to the Village Board; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interest of the Village will be served by the approval of this petition granting variation for the subject
property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND
WILL, ILLINOIS:

Allow the reduction of a rearyard setback by 5 feet, pursuant to Section VII.F.7.

DECEMBER 5, 2000 MINUTES
The meeting of the Lemont Planning & Zoning Commission of the Village
of Lemont was held on Tuesday, December 5, 2000, at the Village Hall.
The meeting was called to order at 7:01 p.m. by Chairman Tom Metzger.
The following Commissioners were present: Paul Bruce, Ellen Pearson,
Jerry Ptacek and Ron Stapleton. Scott Studebaker arrived at 7:07 p.m.
Absent: Katherine Murphy. The following staff was also present: Andy Fitz,
Lisa Friedley and Tim Teddy.
PUBLIC HEARING
A motion was made by Mr. Stapleton and seconded by Mr. Bruce to open
the Public Hearing case number 20.22 Gallagher & Henry Request for
Variation to reduce the required 30 -foot rear yard setback to 26 feet for
Covington Knolls Townhome Phase II, Lot 8. Motion carried 5 -0 by voice
vote.
Mr. Fitz said that Gallagher & Henry is requesting to reduce the minimum
rear yard setback from 30 feet to 26 feet to accommodate an eat -in
kitchen in the rear of the unit. The encroachment will not impact neighbors
in terms of privacy due to the unit abutting a detention pond. Staff
recommends approval of the variance for the minimal impact of the
encroachment and Gallagher & Henry's proactive stance of avoiding other
potential variation requests by building patios and not allowing decks on
all the units.
Terry Woolums, of Gallagher & Henry said that they requested a five foot
variance, not a four foot variance as stated in the agenda, to give them a
cushion. Mr. Woolums said that it is the corner of the dinette in the ranch
unit that encroaches into the setback. Mr. Teddy said that the agenda was
incorrect and the petition was filed for a five foot encroachment.
Mr. Bruce asked if there is only one unit requesting a variance. Mr.
Woolums said yes.
Chairman Metzger asked if the request is appropriate because a ranch is
what the market is looking for and because it would be difficult to redesign
the unit. Mr. Woolums answered yes to both questions and said that they
could change the ranch to a two -story, but that is not what the market is
looking for.
