AN ORDINANCE GRANTING VARIANCE TO PERMIT A
REAR YARD SETBACK TO BE FOURTEEN FEET (14') INSTEAD
OF THE REQUIRED THIRITY FEET (30') AT 1000 EDGEWOOD COURT
IN LEMONT, ILLINOIS
WHEREAS, Davod Shestokas, hereinafter referred to as "the Petitioner ", is agent for the
owner of an approximately 1/4 acre parcel, hereinafter referred to as "the subject property ", located
at 1000 Edgewood Court, in Lemont, Illinois and legally described in Exhibit "A ".
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning
Ordinance for a Variance to permit a rear yard setback to be fourteen feet (14') instead of the required
thirty feet (30'), pursuant to Section VII.E.7.a.(3) of the Lemont Zoning Ordinance; and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in
accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on June 5, 2001;
and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by
law and was published in the Lemont Reporter Met, a newspaper of general circulation within the
Village; and
WHEREAS, the Lemont Planning and Zoning Commission has recommended approval of
the variation to the Village Board; and
WHEREAS, the President and Board of Trustees of the Village have determined that the best
interest of the Village will be served by the approval of this petition granting a variation for the
subject property.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Lemont, that the petitioner, David Shestokas, be granted the requested variation for
reduced rear yard setback.
Section 1. A variation is granted to reduce the rear yard setback from thirty feet to fourteen
feet as depicted on the plan attached as Exhibit `B ".
Section 2. The above variation shall be approved subject to the following conditions:
1. Existing mature trees (6' and greater diameter) in the rear yard shall be located on the
building permit plat plan. If any healthy mature tree is within the minimum rear yard
and the footprint of the proposed deck, it should be incorporated into the deck design.
2. The variation shall apply to a deck only and not any other structure.
3. The petitioner shall obtain a building permit within one year of the effective date of
this ordinance or the variation shall be null and void.

THE VILLAGE OF LEMONT, COUNTY OF COOK, ILLINOIS, on this 25th day of June,
