ALPHONSUS -ST. PATRICK SCHOOL WHEREAS, St. Alphonsus -St. Patrick School, hereinafter referred to as "the Petitioner" is the owner of certain real estate, hereinafter referred to as "the subject property," located at 214 Logan Street, site of the St. Alphonsus Church annex; and WHEREAS, the Petitioner has made application under the provisions of the Lemont Zoning Ordinance 0- 25 -99, for a request for a Special Use to allow the temporary placement of two mobile classroom units, pursuant to Section XVIII.I of the Lemont Zoning Ordinance; and for variations to the Lemont Zoning Ordinance to permit reduction of the corner side yard (east side) setback from 40 feet to 10 feet and the rear yard setback from 30 feet to 20 feet; and WHEREAS, notice of a Public Hearing was published in the Lemont Metropolitan, a newspaper of general circulation within the Village, and a notice of Public Hearing was posted upon the subject property; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont (the "Village ") did heretofore commence and conduct a Public Hearing on July 17, 2001 for the approval of the special use and variations to the Zoning Ordinance; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit and Variations to the Lemont Zoning Ordinance described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DU PAGE, AND WILL, ILLINOIS: SECTION 1: Special Use The Special Use Permit requested by the Petitioner to permit temporary placement of two mobile classroom units on property owned by St. Alphonsus Church at 214 Logan Street is hereby approved subject to the conditions outlined herein; SECTION 2: Zoning Variations The Variations to the Zoning Ordinance to request reduction of the corner side yard setback (east side) from 40 feet to 10 feet, and the rear yard (south) setback from 30 feet to 20 feet are hereby approved subject to the conditions outlined herein; SECTION 3: Conditions 1. The temporary classrooms are limited to a term of not more than five (5) years from the effective date of the ordinance approving the special use and variations; no renewal or extension of the special use and variations is to be granted; 2. No later than three years from the effective date of the ordinance, St. Alphonsus -St. Patrick school shall submit to the Village a plan for permanent additional classroom space whether on or off site. If a plan for permanent additional classrooms is not presented within three years from the effective date of the ordinance, the special use and variations will be revoked and the mobile classrooms must be removed. 3. The structural anchoring system shall be effectively screened from view by siding material and landscaping; 4. Prior to occupancy, a professional quality landscape plan must be developed in consultation with the Logan- Walnut Street neighborhood, and must be submitted to Village staff for review. Landscaping is to be installed this season; 5. The site plan shall be subject to approval of the Lemont Fire Protection Bureau, including, but not limited to, restrictions on street parking in front of the classroom units while school is in session; 6. The special use shall be restricted to normal school use; 7. Upon removal of the temporary modular classrooms, the property shall be restored to remove any damage which may have been caused by the temporary classrooms; 8. No additional modular, mobile, or other temporary classrooms shall be permitted on the church campus.
