ORDINANCE GRANTING THE REQUEST FOR VARIATIONS AT 807 STATE STREET IN
LEMONT, ILLINOIS
WHEREAS, Audrius Remeikis, hereinafter referred to as "the Petitioner ", is the owner of an
approximately .23 acre parcel, hereinafter referred to as "the subject property", located at 807 State Street, in
Lemont, Illinois.
WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance
for a Variance to permit the following variations pursuant to Sections VIII C.5.a -b, XII D.8, and XIII F.
1. A front yard setback of 33'9"
2. A corner side yard setback of 10'3"
3. An interior side yard setback and landscaped area of 10'5"
4. A landscaped area along south edge of parking of 6'6"
5. A rear yard setback and landscaped area of 15'
6. Official execution and approval of the shared parking agreement between the owners of
807 and 805 State Street.
WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with
said Zoning Ordinance, conducted a Public Hearing on the petition on October 2 and November 6, 2001;
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and
was published in the Lemont Reporter Met, a newspaper of general circulation within the Village; and
WHEREAS, notwithstanding failure of the Zoning Board of Appeal's motion to approve the request
for variations, the President and Board of Trustees of the Village have determined that the best interest of the
Village will be served by the approval of this petition for variations.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village
of Lemont, that the Petitioner, Audrius Remeikis, be granted the requested variations.
Section 1. Variations are granted for the following, as depicted on the site plan (Scheme 4A)
attached as Exhibit "A ":
1. A front yard setback of 33'9"
2. A corner side yard setback of 10'3"
3. An interior side yard setback and landscaped area of 10'5"
4. A landscaped area along south edge of parking of 6'6"
5. A rear yard setback and landscaped area of 15'
Section 2. Said variations shall not be effective until the execution of the shared parking agreement
between the owners of 807 and 805 State Street, attached as Exhibit `B ":
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DU PAGE, ILLINOIS, on this 26th
day of November 2001.

Whereas, Audrius T. Re.;.eikis and ViW ana Cof'ee are the. contract purchasers of a
property commoriy known as 807 State Street, Lemont, IL (Location: 1), and Dr. Bruce Corwin
and SWS Leasing are the owners ofa property commonly known as 845 State Street, Lernont, IL
(Location 2) and these properties are adjacent to each other, and Location I is currently the •
subject ofa zoning petition pending before the Village of Lemont to allow the establishme:it ofa ..
retail E:it:rprise, and each party wishes to enhance the value of the repective properties, and in
doing so, promote public safety, the parties agree as follows:
Agreement
1. The parties agree to share parking facilities located upon each property with the
other.
2. The parking facilities will be available to patrons, employees, service personnel and
any others having businss in either location.
3. The parking facilities wil! ba ioi:ted by a common driveway that will allow access
to both properties.
4. The exit and er..trance to the properties will be common and will follow the
applicable ordinances of the village of Lemont.
5. The proposed site plan for the common parking area and traffic pattern. is attached
hereto and incorporated herein as Exhibit
6. The int :t of the parties is to create a mutual easement that wilt "run with the
land ". To that e nd, the parties tares to err_p oy the proper professionals, and
upon the corrrplcticn of this agreement's contirge.ncy (infra, paragraph 8) will
record this agreement and mutual easements with the Recorder of Cook County.
. It is the inter of the panies that this agreement be binding upon their respective
successors and assigns.
8. This agreement is contingent upon the successful rezoning and completion of the

Recording of the easement for the corrpletion of this cont :act will take place
within 30 dyes of he real estate closing for Location I.
9. The parties further agree that each will carry appropriate insurance and name the
other party as an additional insured regarding any issues that rray arise From the
