RESOLUTION APPROVING FINAL PLAT
OF SUBDIVISION FOR SOUTH POINTE
WHEREAS, Phil Cullen, Eagle Ridge Enterprises, Inc., hereinafter referred to as "the
Petitioner ", is the owner of an approximately 11.25 acre parcel, hereinafter referred to as "the
subject property ", generally located west of Deer Lane, south of Old Quarry School, and legally
described in Exhibit "A ", attached; and
WHEREAS, the petitioner has prepared a Final Plat of Subdivision for the subject
property, which is known as South Pointe; and
WHEREAS the petitioner has submitted the Final Plat of Subdivision for the 21 lot
single- family subdivision to be known as South Pointe, attached hereto as Exhibit "A," and;
WHEREAS, the Final Plat of Subdivision is in substantial conformance with the physical
development policies and standards of the Village of Lemont.
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the
Village of Lemont that the Final Plat of Subdivision for South Pointe, which is attached hereto
and made part hereof, is hereby approved subject to the following conditions and the terms and
provisions of the annexation agreement authorized by Ordinance No. 0- 47 -01:
1. All signatures shall be executed on the plat prior to recordation;
2. Land -cash contributions and the annexation fees have been paid to the Village of Lemont in
accordance with Village Ordinances, as follows:

EASEMENT PROVISIONS
Drainage and utility easements are hereby reserved for and granted
to the Village of Lemont an IIIin5l!s municipal corporation, in
DuPage County, Illinois, ('Grantee ) and to those public utility
companies operating under franchise from the Grantee, including but
not limited to Commonwealth Edison Company, Illinois Bell Telephone
Company, Northern Illinois Gas Company, Continental along, Company
through their areas he eon platted assigns "drainage nd utilty under sement
for the perpetual right, privilege and authority to construct,
reconstruct, repair, inspect, maintain, and operate various
underground utility transmissions and distribution systems
including storm and /or sanitary sewers and water mains. Together
with any and all necessary manholes, catch basins, connection
appliances and other structures and appurtenances as may be deemed
necessary by Grantee and also to convey storm waters over, upon,
sa d e through together right acces across the property necessary persons and equipment to
perform any or all of the above work.
The right is also granted to cut down, trim or remove any trees,
shrubs or other plants on the easement that interfere with the
operation of the sewers, utilities or the conveyances of storm
waters. No permanent buildings shall be placed on said easement,
surfaced edri driveways, aisles used aanid gardens, areas and such pother purposes
and improvements that do not then or later interfere with the
aforesaid uses and rights. Where an easement is used both for
sewer and other utilities, the other utility installation shall be
subject to the approval of the Grantee as to design and location;
all installations are subject to the ordinances of the Grantee.
An easement is hereby reserved for and granted to
NORTHERN ILLINOIS GAS COMPANY, its successors and
assigns, in all platted "easement" areas, streets, alleys,
other public ways and places shown on this plat, said
easement to be for installation, maintenance, relocation,
renewal and removal of gas mains and appurtenances
for the purpose of serving all areas shown on this
plot o or as well as other property, whether o not con—
contiguous thereto. No buildings of other structures shall be
constructed of erected in any such "easement" areas,
streets, alleys, or other public ways of places nor shall
any other use be made thereof which will interfere with
the easements reserved and granted hereby.
