ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT This 8th day of July , 2002 Published in pamphlet form by authority of the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will, and DuPage, Illinois this 8th day of July , 2002. • ORDINANCE AN ORDINANCE GRANTING THE REQUEST FOR REZONING FOR A 15 ACRE PARCEL, GENERALLY LOCATED SOUTH OF MC CARTHY ROAD, WEST OF WALKER ROAD AND APPROVING A SPECIAL USE FOR A PRELIMINARY PLANNED UNIT DEVELOPMENT (AMBERWOOD P.U.D.) WHEREAS, Mr. Stephen Dignan, Dignan Development LLC, hereinafter referred to as "the Petitioner," is the contract owner of an approximately 15 acre parcel, hereinafter referred to as "the subject property" with the P.I.N. # 22 -28- 401 -001 in Lemont, Illinois; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for the rezoning of the parcel in question to underlying R -5/R -4 (Single Family Detached Residence District) from Cook County R -3 Zoning (Single Family Residence District), pursuant to Section XVIII (J) and for approval of a preliminary Planned Unit Development; and WHEREAS, whereas the Zoning Board of Appeals of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted a Public Hearing on the petition on May 7, 2002; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter -Met, a newspaper of general circulation within the Village; and WHEREAS, the Zoning Board of Appeals has recommended approval of the rezoning and preliminary Planned Unit Development to the Village Board. NOW THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont as follows: Section 1. A zoning map amendment is granted to allow the change in the zoning classification of the parcel with P.I.N. 22 -28- 401 -001 to underlying R -5 Single Family Attached Residence District/R -4 Single Family Detached Residence District) from Cook County R -3 Zoning (Single Family Residence District). Section 2. The Planned Unit Development is hereby approved subject to the following conditions of approval: 1. The property will be developed according to the terms of the annexation agreement. 2. The petitioner shall obtain a dedication of additional right of way for the south extension of Walker Road, sufficient to make a 66 foot right of way as depicted on the plan. 3. Final landscape plans detailing the species, installation size, quantity and location of all plantings, including building perimeter plantings, private common area plantings and street trees, shall be submitted prior to final plat approval. 4 A final tree preservation plan shall be submitted prior to final plat approval, detailing trees to be preserved, trees to be removed, and tree protection measures. All trees that are desirable species and I healthy condition within the 1.3 acre open space parcel shall be preserved. 5. The building elevations shall be amended to include quoins on the corners and limestone banding. 6. Development shall be consistent with the following attached exhibits: a. Site plan/preliminary engineering plan dated June 6, 2002. b. Landscape plan and tree preservation plan dated June 5, 2002. c.
