This 27th day of January, 2003 ORDINANCE 0 `6 AN ORDINANCE AMENDING SECTIONS OF ORDINANCE #456, LEMONT SUBDIVISION REGULATIONS, AS AMENDED, PERTAINING TO THE COMBINED SEWER SYSTEM WHEREAS, The Village of Lemont has the authority to regulate matters affecting the health, safety, and welfare of the community; and WHEREAS, The Illinois Environmental Protection Agency, under the authority of the United States Environmental Protection Agency, has taken action through the National Pollutant Discharge Elimination System (NPDES) Permit Program to regulate discharges from Combined Sewer Overflows (CSO) to Waters of the United States; and WHEREAS, the Village of Lemont is the operator of a Combined Sewer System (CSS) which conveys both domestic sanitary wastes and stormwater runoff in the same conduit, and which includes CSO locations which relieve overloading of the CSS and surcharging into streets and basements during excess flow situations by allowing portions of the excess flow to discharge to the Illinois & Michigan (I &M) Canal; and WHEREAS, the Illinois Environmental Protection Agency has issued a NPDES Permit to the Village of Lemont authorizing discharge at the CSOs in compliance with the provisions of the Illinois Environmental Protection Act, Subtitle C, Chapter 1; the Clean water Act; and Special Conditions set forth in the permit document; and WHEREAS, the Special Conditions of the NPDES Permit issued to the Village of Lemont require the permittee (Village of Lemont) to review and modify as necessary its Sewer Use Ordinance to ensure it contains provisions as noted in the NPDES Permit. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that Ordinance 456, known as the Lemont Subdivision Regulations, as amended by Ordinance 879, shall be amended to provide the following replacements of Sections XI -A -2, XI -A -7, and XI -A -12: XI -A -2. Sanitary sewer flows from new construction shall be directed to the Lemont separate sanitary sewer system not tributary to the combined sewer system whenever access to the separate sanitary sewer system is available. Existing stormwater inflow sources on the combined sewer system shall be removed from the combined sewer system and connected to a separate storm sewer within 365 days if a storm sewer becomes available within 50 feet of the inflow source. XI A -7 -7. New construction within the combined sewer system area shall be provided with a separate stormwater drainage system not tributary to the combined sewer system. New storm water inflow sources to the sanitary sewer system shall be prohibited. If it is not possible to convey all stormwater to a separate stormwater drainage system, stormwater inflow to the combined sewer system shall be minimized to the maximum extent practical. Where stormwater flows must be tributary to the combined sewer system, facilities shall be designed to detain and restrict to a controlled rate the inflow of stormwater to the combined sewer system, subject to review by the Village Engineer. XI -A -12. New construction tributary to the combined sewer system shall have its domestic sanitary waste connection separate from any stormwater inflow connection to facilitate disconnection if a separate sanitary sewer becomes available. The Combined sewer Overflow (CSO) impacts of non- domestic inflow sources to the combined sewer system, or to the sanitary sewers that discharge to the combined sewer system, shall be minimized. The terms of this Ordinance shall be modified as needed from time to time in order to control pollutants in these discharges. This ordinance shall be in full force and effect after its passage, approval and publication in the manner provided by law. All ordinances or parts of ordinances in conflict herewith shall be and the same are hereby repealed. The Village Clerk of the Village of Lemont shall certify to the adoption of this ordinance and cause the same to be published in pamphlet form.
