ORDINANCE NO.O AN ORDINANCE APPROVING A VARIATION OF THE MAXIMUM DEPTH OF THE DETENTION BASINS IN MAYFAIR ESTATES SUBDIVISION IN LEMONT, IL WHEREAS, Dr. Evans, Rolling Meadows L.L.C., hereinafter referred to as "the Petitioner ", is the owner of an approximately 28.5 acre parcel, hereinafter referred to as "the subject property ", generally located east of Rolling Meadows Subdivision, south of 127th Street, west of the toll road, and legally described in Exhibit "A ", attached; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a variations of the maximum depth of the stormwater detention basins pursuant to Section VII.7.02.A.9. of the Subdivision Regulations; and WHEREAS, the Plan Commission of the Village of Lemont, Illinois ( "the Village ") did heretofore conduct a review of the requested relief; and WHEREAS, the Village of Lemont Plan Commission has recommended approval of variations of the maximum depth of the stormwater detention basins; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the adoption of said variation ordinance as described herein; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS that the Petitioner, Dr. Thomas Evans, Rolling Meadows, L.L.C., be granted the variations in the maximum depth of the detention basin from four feet (4') to five feet two inches (5' 2 ") and five feet four inches (5' 4 "). THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY LAW. 2 PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE AND WILL, ILLINOIS, ON THIS 10Th DAY OF MARCH, 2003.
