ORDINANCE AMENDING CHAPTER 2.12 OF THE LEMONT
MUNICIPAL CODE - VILLAGE ADMINISTRATOR
NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the
Village of Lemont that:
SECTION 1: Chapter 2.12 of the Lemont Municipal Code is hereby repealed and
replaced as follows:
Appointment
The village administrator shall be appointed by the village president, with the advice and consent
of the village board or trustees.
Qualifications
The Village Administrator shall be chosen on the basis of executive and administrative
qualifications with special reference to actual experience in, and knowledge of, accepted practices
with respect to the duties of his or her employment as set forth herein and in the job description as
established from time to time by the Mayor and Village Board. At the time of such appointment,
the Village Administrator need not be a resident of the Village, but shall reside within the Village
limits within twelve (12) months of appointment.
Employment by contract — Restrictions.
A. The administrator shall be employed by contract, the terms of which shall be agreed upon
by both the administrator and a majority of the corporate authorities of the village. The
term of the village administrator shall be no less than one year.
B. The administrator may not be employed by any other governmental body or business
during the period of employment with the Village.
Temporary administrators
During the absence or disability of the administrator, the village president, with the advice and
consent of the village board of trustees, may designate some properly qualified village employee
to act as temporary administrator possessing all of the powers of village administrator.
Powers & Duties
The Village Administrator shall be the chief administrative officer of the Village. Nothing set
forth in this section shall give the Village Administrator powers not permitted by professional
ethics and standards. He or she shall be responsible to the Mayor and Village Board for the proper
administration of the affairs of the Village, and shall have the following powers:
A. To enforce the ordinances of the Village.
B. Supervise and coordinate the work of all departments of the Village.
C. Recommend appointment, discipline and removal of staff officers of the Village who
are appointed by the Mayor pursuant to Village ordinances, and, as to removal or
suspension, when such removal or suspension will be consistent with the best interests of
the Village.
D. Supervise and assist the appointed staff officers of the Village. All appointed staff
officers shall perform their duties subject to the direction of the Village Administrator,
except as otherwise provided or required by statute or Village ordinance.
E. Supervise and assist all staff officers of the Village in the performance of their
respective duties. All staff officers and employees of the Village shall furnish and disclose
to the Village Administrator such oral or written information and material relating to the
affairs of the Village as he or she shall request.
F. Attend all meetings of the Village Board unless excused by the Village Board. The
Village Administrator shall have the right to take part in the discussion of all matters
coming before the Village Board and shall make recommendations on all matters under
his or her purview, but shall have no right to vote. The Village Administrator shall be
entitled to notice of all regular and special meetings of the Village Board.
G. Investigate all complaints in relation to matters concerning the administration,
operation and activities of the government of the Village and services maintained by the
public utilities in the Village and see that all franchises, permits and privileges granted by
the Village are faithfully observed.
H. Provide or cause to be provided administrative support to all Village boards and
commissions and make recommendations to the Village Board and boards and
commissions relating to matters of public health, safety or welfare, economic
development or general public improvements. Said duties shall not supersede any
authorities vested with the Village Board, boards or commissions under the state or
Village ordinance.
I. Recommend to the Mayor and Village Board from time to time, the adoption of such
measures as he or she may deem necessary or expedient for the health, safety or welfare
of the community and for the improvement of administrative services.
J. Oversee the purchase of all materials, supplies, equipment and services for which funds
are provided in the budget according to the directives and mandates of State law and
Village ordinances.
K. Oversee the determination of the salaries, wages, and hours and conditions of
employment of all employees, subject to the approval of Mayor and Village Board.
L. Hire, suspend, or remove all employees of the Village, except those appointed by the
Mayor with the advice and consent of the Village Board and except those positions
covered by state law, or by agreement such as collective bargaining agreements. His /her
authority to hire, suspend, or remove all Village employees shall take precedence over any
conflicting ordinances. Such hiring, appointments, suspensions or removals shall be based
upon the merit and fitness of such employee, without regard to political belief or
affiliation. The Village Administrator may authorize the head of a department or office to
hire, suspend or remove such employee in such department or office, in accordance with
Village personnel policies and procedures.
M. Oversee the maintenance of current inventory of all real and personal property of the
Village and the location of such property. He /She shall be responsible for the care and
custody of all Village property which is not by state law or Village ordinance assigned to
some other officer or body for care and control.
N. Prepare, or cause to be prepared, a budget report as required by the Illinois Compiled
Statutes indicating the funds necessary to defray the estimated expenses of the Village for
the fiscal year. Prepare, or cause to be prepared, the annual budget in time for
consideration and enactment by the Village Board as required by State law, and prepare,
or cause to be prepared, the annual tax levy.
O. Act as business manager for the Village under the direction of the Mayor and Village
Board and in cooperation with the Village Treasurer, and Village Clerk. He or she shall
control and direct all expenditures made by the Village. He or she shall before the same is
presented to the village board for approval, certify as to the correctness of all bills and
accounts, and shall have supervision, over the accounting and finance work of the Village,
and shall keep or cause to be kept, full and complete books of accounts showing the exact
condition of the financial affairs of the Village, and shall supervise the keeping of all
necessary records to accomplish this to the extent that such supervision is not vested in the
Village Treasurer or Village Clerk by state statute.
P. The representation of the Village in any community or intergovernmental functions as
may be directed by the Mayor.
Q. Devote full time to the discharge of his /her official duties and not engage in any other
employment without the written consent of the Mayor and Village Board.
R. Perform other duties as may be required by resolution, ordinance or direction of the
Mayor and /or Village Board.
Annual evaluations — Criteria
A. An evaluation of the administrator shall be conducted by the mayor and board of trustees
every twelve months. The evaluation shall be in writing and given to the administrator at
an evaluation meeting to be discussed with him or her.
B. Although the village administrator has numerous administrative duties prescribed above in
this chapter, one of the chief assets of the administrator shall be his accessibility to the
citizens of the village. He must be attentive to the everyday occurrences within the village
that have a signal impact upon the residents. It is his responsibility to be aware of
community feelings, community problems, as well as community sensitivities. He must
be able to balance what is possible and feasible against what is idealistic and impractical.
To this extent, the village administrator must be cognizant of the various policies
promulgated by the president and board of trustees. The administrator is constantly the
focal point of citizens' complaints. To this end, he must show a willingness to listen
attentively and conduct himself in a composed manner, yet all times working for the best
interest of the entire community.
SECTION 2: Effective Date: This Ordinance shall be in full force and effect from
and after its passage, approval and publication in the manner provided by law.
SECTION 3: Repealer: All Ordinances or parts of Ordinances in conflict herewith
shall be and the same are hereby repealed.
The Village Clerk of the Village of Lemont shall certify to the adoption of this
Ordinance and cause the same to be published in pamphlet form.
