R-39-02 06/10/02RESOLUTION RESOLUTION GRANTING APPROVAL TO USE METAL EXTERIOR PANELS FOR A BUILDING LOCATED AT 11400 OLD LEMONT ROAD WHEREAS, Ozinga Illinois RMC is the lessee of the property located at 11400 Old Lemont Road in the Village of Lemont; and, WHEREAS, Ozinga Illinois RMC is proposing to enclose their plant operations located at 11400 Old Lemont Road in the Village of Lemont; and, WHEREAS, Village of Lemont Ordinance 0-69-9& establishing exterior facade; requirements for structures other than single family and townhouse construction provides for the sole use efface brick, split face masonry, stucco-, EIFS, or other approved composite systems for buildings of this nature; and, WHEREAS, Village of Lemont Ordinance 0 -69-95 also- allows the Board the option to approve metal exteriors on a case -by -case basis. NOW, THEREFORE BE IT RESOLVED that upon Board consideration of the attached proposal the use of metal exterior panels for enclosure of the concrete batch -plant for Ozinga Illinois RMC at 11400 Old Lemont Road is hereby approved. Our request before the Board to enclose our production plant equipment will provide for an improved appearance as Ozinga promised the previous Village Administration. As previously stated in our meeting with Michael Bogert and Timothy Teddy, Ozinga is open to working with the Village of Lemont in regard to an alternative suitable location for our ready mix concrete production facility. Ozinga and the Village of Lemont have worked together successfully in the past and that is precisely why Ozinga is located in the Village of Lemont in exactly the location that the Village of Lemont specified. Ozinga looks forward to continuing our long-term business enterprise in the Village of Lemont, benefiting and supporting the Village of Lemont, its residents, as well as our customers and our employees. ARTICLE EIGHT 8.01 Any notice herein provided to be given shall be deemed properly served if delivered in writing personally or mailed by registered or certified mail, postage prepaid, return receipt requested to the District in care of the General Superintendent, 100 East Erie Street, Chicago, Illinois 60611, or to the Permittee in care of: Richard DeBoer Executive Vice - President Ozinga Bros., Inc. 15959 South 108t Avenue Orland Park, Illinois 60467 or to such other persons or addresses as either party may from time to time designate in writing. 8.02 In the event that the Permittee hereinabove contemplated shall consist of two or more parties, each and every party shall be jointly and severally liable for the faithful and complete performance of each and every provision of this Permit. 8.03 Permittee expressly acknowledges that the District has made no representations, warranties, express or implied, as to the adequacy, fitness or condition of Permit Premises or the improvements upon the Permit Premises. Permittee accepts the Permit Premises and the improvements thereon, if any, `AS -IS" and `WITH ALL FAULTS ". Permittee acknowledges that it has inspected the permit premises and has satisfied itself as to the adequacy, fitness and condition thereof. -7-
