RESOLUTION AUTHORIZING THE VILLAGE TO ENTER INTO AN AGREEMENT FOR
A GRANT OF EASEMENT AT 1015 CHEROKEE
WHEREAS, the President and Board of Trustees have deemed it in the community's best
interest to enter into an agreement granting an easement at 1015 Cherokee, attached hereto as
Exhibit "A" and made a part hereof; and
WHEREAS, the Agreement will assist the Village of Lemont in recognition that, at a
given time, access to the utilities located within said easement may be necessary to assure
continuous operation of the Village infrastructure system.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Lemont, Counties of Cook, Will and DuPage, Illinois, that the Village Board of
Trustees authorizes the President and Clerk to sign the attached Agreement.

INDEMNITY AGREEMENT
THIS AGREEMENT is made and entered into this
day of , 2002, by and between the
VILLAGE OF LEMONT, a Municipal Corporation,
hereinafter referred to as "Grantee ", and MICHAEL
BRACKEN and BONNIE BRACKEN, husband and wife,
1015 Cherokee, Lemont, Illinois, hereinafter referred
to as "Grantors ".
WITNESSETH:
WHEREAS, Grantors are willing to grant to the Grantee a perpetual easement subject to the terms, covenants
and conditions hereinafter set forth:
NOW, THEREFORE, in consideration of the mutual promises and undertakings and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the Grantors hereby grant the Grantee
its successors and assigns a perpetual subterranean easement to the VILLAGE OF LEMONT, its successors and assigns.
for the full and free right and authority to maintain and to install a sanitary sewer pipe in the "Easement Premises" legally
described as:
The East 27.5 feet of Lot 30 in Rose Hill Subdivision, part of the Northwest '/4 of the Southeast %a of
Section 29, Township 37 North, Range I I , East of the Third Principal Meridian, recorded December
8, 1970 as Document No. 21338096, in Cook County, Illinois.

The Grantor represents and warrants to the Grantee that Grantor is the true and lawful owner of the Property
and has full right and power to grant and convey the rights conveyed herein, and will not expand the current wooden
deck over the easement parcel, but may repair or replace the same at current location.
The Grantee hereby agrees to restore all property disturbed by its activities in use of the easement to the
condition existing prior to the disturbance except a wooden deck, which Grantee shall not be responsible to repair.
Prior to commencing any work, the Grantee shall notify the Grantor of its intention to commence work.
In consideration of the execution and delivery of this Easement, the Grantee hereby indemnifies and agrees to
hold harmless the Grantors from any and all actions, suits, losses, costs, liabilities, and specifically including, but not
limited to damages to the Grantors residence and property owned by Grantors.
This Easement is binding upon and shall inure to the benefit of the heirs, successors, assigns, and licensees of
the parties hereto.
