RESOLUTION
RESOLUTION ACCEPTING EASEMENT AGREEMENT
FOR PUBLIC SIDEWALK AT 1151 MC CARTHY ROAD
WHEREAS, the Village of Lemont is proposing to undertake public sidewalk
improvements on McCarthy Road between Fourth Street and Woodcrest Drive, and
WHEREAS, portions of the public sidewalk lie on privately owned properties at 1151
McCarthy Road, with ownership belonging to Nicholas and Maureen Orlando; and
WHEREAS, the Village has requested that the owners dedicate a public sidewalk
easement for such improvements.
NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Trustees that
the attached Easement Agreement with Nicholas and Maureen Orlando is hereby approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE,
ILLINOIS, on this 23" day of September , 2002.

DEDICATION AGREEMENT
THIS AGREEMENT is made and entered into
this 2211d day of April, 2002, by and between the
VILLAGE OF LEMONT, a Municipal
Corporation, hereinafter referred to as
"Grantee ", and Nicholas Orlando and Maureen
Orlando, his wife, hereinafter referred to as
"Grantor ".
WITNESSETH:
WHEREAS, Grantor is willing to grant to the Grantee a dedication of the subject property
subject to the terms, covenants and conditions hereinafter set forth:
NOW, THEREFORE, in consideration of the mutual promises and undertakings and
other good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, the Grantor hereby grants without warranty of title to the Grantee its successors
and assigns a dedication of the subject property to the VILLAGE OF LEMONT, its successors
and assigns, for public purposes, including but not limited to, the full and free right and authority
to install, construct, relocate, replace, inspect, operate, repair and maintain roadways, sidewalks,
street lights, water mains, fire hydrants, valves and water service facilities, sanitary sewer pipes,
manholes and sewer connections, storm sewer pipes, manholes, inlets and service connections,
gas mains, valves, service lines and meters, electric transmission, and such other appurtenances
and facilities as may be necessary or convenient related to said improvements, in, on, upon, over
through, across and under all of the "Subject Premises" legally described as:
THE SOUTHERLY 33 FEET OF THE EAST 60 FEET OF LOT 2 IN THE
SUBDIVISION OF LOT 42 IN BECKER'S SUBDIVISION OF THE EAST % OF THE
NORTHWEST 1/4 OF SECTION 28, TOWNSHIP 37 NORTH, RANGE 11 EAST OF
THE THIRD PRINCIPAL MEREDIAN, ACCORDING THE TO PLAT THEREOF
RECORDED OCTOBER 20, 1890 IN BOOK 44 OF PLATS, PAGE 39, AS
DOCUMENT NUMBER 1356956, IN COOK COUNTY, ILLINOIS.

The Grantors represent and warrant to the Grantee that Grantors are the true and lawful
owners of the Property and have full right and power to grant and convey the rights conveyed
herein.
The Grantee hereby agrees to require contractors to restore Grantors' property to
substantially the same condition existing prior to the disturbance.
The Grantee shall have the right to remove or trim such trees and brush in the Dedicated
Area as is necessary to exercise the rights conveyed herein.
This Grant is binding upon and shall inure to the benefit of the heirs, successors, assigns,
and licensees of the parties hereto.

Cook, Will and DuPage, Illinois, this 22nd day of April, 2002.
