ORDINANCE NO.7) AN ORDINANCE APPROVING A SPECIAL USE IN THE B -3 DISTRICT ( 700 Main Street, Lemont, Illinois) WHEREAS, an application has been filed by Stan B. Tomala, duly authorized agent for John Grele, in connection with a Request for Special Use for the property legally described in Exhibit "A" and located at 700 Main Street, Lemont, Illinois; and WHEREAS, the Petitioner made application under the provisions of Lemont Zoning Ordinance 0- 26 -99, for a request for a Special Use to permit 2 dwelling units as a Unique Use in the B -3 District, pursuant to Section VIII.E.2.u. of the Lemont Zoning Ordinance; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter/Met a newspaper of general circulation within the Village; and WHEREAS, the Zoning Board of Appeals of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on December 18, 2001 for approval of a Special Use; and WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public hearing as required by law, approved a Special Use Permit; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit described herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: SECTION 1: Special Use. The subject property described above is hereby permitted 2 dwelling units as a. Unique Use in a B -3 Arterial Commercial District, pursuant to Section VIII.E.2.u. of the Lemont Zoning Ordinance. SECTION 2: Conditions. The Special Use is subject to the following conditions: 1) The project shall be built substantially in conformance with the site plan, attached as exhibit `B ", the building elevations, attached as exhibit "C ", and the floor plan attached as exhibit "D "; 2) The plat of consolidation shall be prepared by the petitioner, through which the Main Street frontage shall be dedicated, within 60 days of Village Board Approval; 2 3) Curb stops shall be installed in the parking lot; 4) Additional landscaping shall be provided, per staff review and approval, along the southeast and east property lines; and 5) If a building permit for the addition is not issued within one (1) year from the date of Village Board approval, the Special Use shall expire. 6) Incorporate additional decorative cornice detail at the roof line, per Community Development Department Review. 7) Flexibility with indoor parking capabilities should be exercised to accommodate a blend of residential and business. 8) The occupancy of future busineses will be based upon or limited to the ability to meet Village parking requirements. 9) Approval shall be subject to final engineering approval.
