Plat, PUD and Zoning Courtyards of BriarcliffeVILLAGE OF LEMONT ORDINANCE NO • /0 AN ORDINANCE GRANTING PRELIMINARY PUD PLAN /PLAT APPROVAL, A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) AND A ZONING MAP AMENDMENT FROM B -3 ARTERIAL COMMERCIAL ZONING DISTRICT TO R -5 SINGLE FAMILY ATTACHED RESIDENTIAL ZONING DISTRICT FOR A TOWNHOME SUBDIVISION ON A 4.76 ACRE PARCEL LOCATED AT 12660 THORNBERRY DRIVE, IN LEMONT, IL (Courtyards of Briarcliffe) ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 13th DAY OF SEPTEMBER, 2010 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DUPAGE COUNTIES, ILLINOIS, THIS 13TH DAY OF SEPTEMBER, 2010 1 ORDINANCE NO. a -C.0? i (CJ AN ORDINANCE GRANTING PRELIMINARY PUD PLAN /PLAT APPROVAL, A SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT (PUD) AND A ZONING MAP AMENDMENT FROM B -3 ARTERIAL COMMERCIAL ZONING DISTRICT TO R -5 SINGLE FAMILY ATTACHED RESIDENTIAL ZONING DISTRICT FOR A TOWNHOME SUBDIVISION ON A 4.76 ACRE PARCEL GENERALLY LOCATED AT 12660 THORNBERRY DRIVE IN LEMONT, IL (Courtyards of Briarcliffe) WHEREAS, Lynette McNaughton (hereinafter referred to as the "Petitioner ") is the owner of the subject property covering approximately 4.76 acres located at 12660 Thornberry Drive (PIN# 22 -30- 305 -008) and legally described in Exhibit "A ", attached hereto and incorporated herein, and shown on the Plat of Survey, attached hereto and incorporated herein as Exhibit `B "; and WHEREAS, the Petitioner made application under the provisions of the Lemont Unified Development Ordinance for preliminary PUD plan /plat approval, a zoning map amendment from Lemont B -3 Arterial Commercial District to Lemont R -5 Single - Family Attached Residential District and a Special Use for a planned unit development consisting of a 34 unit townhome subdivision; and WHEREAS, the petitioner has submitted a PUD Preliminary Plan /Plat consisting of the following: 1. Preliminary Site Plan, prepared by DesignTek Engineering Inc. and dated 2 -21 -07 with a revision date of 07- 12 -10, attached hereto as Exhibit C; 2. Building Setback Exhibit, prepared by DesignTek Engineering Inc. and dated 2- 21-07 with a revision date of 07- 12 -10, attached hereto as Exhibit D; 3. Preliminary Engineering Plan, prepared by DesignTek Engineering Inc. and dated 1 -26 -09 with a revision date of 07- 12 -10, attached hereto as Exhibit E; 4. Final Landscape Plan, prepared by Ives /Ryan Group Inc. and dated 12 -22 -08 with a revision date of 08- 03 -10, attached hereto as Exhibit F; and 5. Character Elevations, prepared by BSB Design and dated 1- 26 -09, attached hereto as Exhibit G. ii WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in accordance with Lemont Unified Development Ordinance, conducted public hearings on the application on February 18, 2009, and March 18, 2009 and voted to recommend approval of the applicant's request with conditions; and WHEREAS, the President and Board of Trustees of the Village of Lemont hereby concur with and adopt the following findings of fact recommended by the Planning and Zoning Commission at the aforementioned public hearing: 1. A zoning map amendment of the subject property from B -3 to R -5 is more consistent with surrounding land uses. 2. The townhomes proposal will generate less traffic and have a lower density than if the subject property had a commercial zoning classification. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont: Section 1 Special Use and Zoning Map Amendment. The PUD Preliminary Plan/Plat with zoning map amendment to R -5 Single - Family Attached Residential District with special use for a planned unit development is approved with the following conditions: 1. The Planned Unit Development Preliminary Plan/Plat approval, and the bulk exceptions granted therein, shall lapse in the event the petitioner does not file a complete application for a PUD final plan /plat within one (1) year of the effective date of this ordinance. 2. In the event the petitioner does not file a complete application for a PUD final plan /plat within one (1) year of the effective date of this ordinance, the zoning of the subject property shall revert to the R -1 Single- Family Residential zoning district. Section 2. Publication. That this ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. Section 3.0- 72 -07. Ordinance 0- 72 -07, which granted a PUD for commercial office condominiums on the subject site, shall become null and void upon the effective date of this ordinance. 3 PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE AND WILL, ILLINOIS, ON THIS 13th DAY OF SEPTEMBER, 2010.
