R 5IQ og A RESOLUTION AUTHORIZING THE RELEASE OF THE LETTER OF CREDIT FOR 903 EAST STREET EXTENSION WHEREAS, pursuant to the Subdivision Regulations, an owner or developer of a subdivision is required to deposit certain security or evidence thereof with the Village of Lemont to guarantee the installation of such improvements; and WHEREAS, on behalf of Mr. Andrew Fudala and Mrs. Margaret Fudala Letter of Credit (LOC) #2005 -364 was issued by State Bank of Countryside in the amount of $46,000.00 and was deposited with the Village in August 26, 2005 to guarantee costs associated with the extension of East Street to the Fudala property at 903 East Street; and WHEREAS, the Village Engineer and the Community Development Director subsequently determined the fair and appropriate share of Mr. and Mrs. Fudala's costs of the East Street extension to be $15,587.49; and WHEREAS, on behalf of Mr. and Mrs. Fudala the State Bank of Countryside has issued cashier's check No. L018856 to the Village of Lemont in the amount of $15,587.49 for said share of construction costs. NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont that Letter of Credit # 2005 -364 is hereby released.
