A RESOLUTION AUTHORIZING THE RELEASE OF THE LETTER OF CREDIT FOR
903 EAST STREET EXTENSION
WHEREAS, pursuant to the Subdivision Regulations, an owner or developer of a
subdivision is required to deposit certain security or evidence thereof with the Village of Lemont
to guarantee the installation of such improvements; and
WHEREAS, on behalf of Mr. Andrew Fudala and Mrs. Margaret Fudala Letter of Credit
(LOC) #2005 -364 was issued by State Bank of Countryside in the amount of $46,000.00 and was
deposited with the Village in August 26, 2005 to guarantee costs associated with the extension of
East Street to the Fudala property at 903 East Street; and
WHEREAS, the Village Engineer and the Community Development Director
subsequently determined the fair and appropriate share of Mr. and Mrs. Fudala's costs of the
East Street extension to be $15,587.49; and
WHEREAS, on behalf of Mr. and Mrs. Fudala the State Bank of Countryside has issued
cashier's check No. L018856 to the Village of Lemont in the amount of $15,587.49 for said
share of construction costs.
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont that Letter of Credit # 2005 -364 is hereby released.
PASS AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DuPAGE,
ILLINOIS, on this 25th day of August, 2008.

A RESOLUTION APPROVING VARIATIONS AND WAIVERS OF THE
LEMONT SUBDIVISION REGULATIONS, ORDINANCE #456
( Lot 12 in Lemont Gardens, or 903 East Street)
WHEREAS, Margaret and Andrew Fudala are the owners (hereinafter known as
petitioner) is the owner of the subject property consisting of approximately .25 acres,
lot 12 in Lemont Gardens, (commonly known as 903 East Street), and legally described
as:
Lot 12 in Lemont Gardens, a subdivision of lots 13 and 14 in County
Clerk's Division of Section 29, Township 37 North, Range 11, East of
the Third Principal Meridian, in Cook County, Illinois; and
WHEREAS, the petitioner has requested variations of the Subdivision
Regulations to construct a single family dwelling on the subject property; and
WHEREAS, the Lemont Plan Commission reviewed the proposed variations of
the Subdivision Regulations as provided in Section XVI of Ordinance 456 and
recommends approval; and
WHEREAS, the petitioner prepared an engineering drawing illustrating a street
extension, temporary "tee" turnaround and storm sewer public improvements within
existing unimproved right -of -way, attached hereto and made a part hereof as "Exhibit
B"; and
WHEREAS, the President and Board of Trustees have determined that the
approval of the specified engineering plan, and variations of the Subdivision
Regulations, Ordinance #456, shall be in the best interest of the Village; and
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees that the requested relief shall consist of the following:
Section 1. Street construction shall not be required within the Short Street right
of way east of East Street, including waiver of public sidewalk and parkway trees along
Short Street.
Section 2. No additional street lights attributable to construction of the dwelling
on Lot 12 shall be required.
Section 3.. The extension of East Street shall be required along the entire
frontage of Lot 12 and shall terminate in a "Tee" turnaround at approximately the center
line of Short Street.
Section 4. Site improvements shall be constructed in general conformance with
the "Site Grading Plan" prepared by Edward W. Podczerwinski, P.E., last revised May
8, 2004.
Section 5. The applicant shall provide a financial guarantee for the street
construction as provided in the Subdivision Regulations.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL,
AND DuPAGE, ILLINOIS, on this 24'h day of May, 2004.

We hereby establish in your favor our Irrevocable Standby Letter of Credit #2005 -364 in the
amount of $46,000.00 which is available with us by sight payment against presentation of your drafts) at
sight, drawn on us bearing the clause "Drawn under State Bank of Countryside, a National banking
association, Countryside, Illinois, Credit Number #2005 -364 and accompanied by your signed statement
on your letterhead reading as follows:
"Andrew and Margaret Fudala have failed to make the required improvements as
per agreement with the Village of Lemont ".
This Irrevocable Standby Letter of Credit #2005 -364 shall expire on August 26, 2006 except that
30 days prior to expiration we shall notify the Village of Lemont by registered letter, return receipt
requested, of the impending expiration date. This commitment shall not terminate without such
notice. If the work covered by this commitment has not been completed within the time set forth, the
Village may, at its option, continue drawing on the letter for an additional six month period.
Upon completion and acceptance of the street on the property described below, the Village of
Lemont will no longer require said Letter of Credit.
