A RESOLUTION AUTHORIZING ACCEPTANCE OF PUBLIC IMPROVEMENTS
FOR COVINGTON KNOLLS SUBDIVISION - SINGLE FAMILY UNIT ONE
WHEREAS, the Village of Lemont has adopted Ordinance 456, the Subdivision Regulations
of the Municipal Code, to provide for the orderly growth of the Village and those territories within
one and one half miles of the corporate limits; and
WHEREAS, in accordance with Section X of the Subdivision Control Ordinance, the
Village Board of Trustees shall consider requests to accept public improvements upon completion of
same; and
WHEREAS, Gallagher & Henry, the developer of property known as "Covington Knolls
Subdivision, Single Family Unit One" has submitted a bill of sale and has petitioned the Village for
acceptance of the public improvements in said subdivision; and
WHEREAS, Village Staff and Village Engineer have reviewed Covington Knolls
Subdivision, Single Family Unit One improvements for compliance with approved plans, the Lemont
Subdivision Control Ordinance, and the Covington Knolls Consent Decree, and recommended
approval of the request with conditions; and
WHEREAS, the Village will release Letter of Credit S501645, held to guarantee installation
of the public improvements, and since they have been found to be satisfactory, excepting a letter of
credit maintenance guarantee for a period of two years from the date of acceptance and certain
conditions, listed below.
NOW, THEREFORE, BE IT RESOLVED, that the Village of Lemont President and
Board of Trustees hereby accept Covington Knolls Subdivision Single Family - Unit One accordance
with the terms of the Lemont Subdivision Control Ordinance subject to the conditions listed below:
Section 1: Detention basins 1, 2 and 3 are not to be accepted at this time. A provision for
future clean-up of these basins must be provided;
Section 2: Those portions of Covington Drive, Overton Court, Pendleton Drive, Bennington
Court, Camelot Drive and Chelsea Court that are not adjacent to future Single Family Unit 8, must
be repaired and resurfaced, and an amount of $300,000 will be added to the maintenance bond
amount to ensure this is done; (those portions of these streets that are adjacent to Single Family Unit
8 will be repaired and resurfaced at time of acceptance of Unit 8.)
Section 3: An additional $200,000 will be added to the maintenance bond amount to
guarantee clean-up and re- sodding of Detention Basin No 1, and thereafter, basins can be accepted
after build -out of Unit 7 and Unit 8;
Section 4: The total two -year maintenance guarantee shall be posted equal to ten percent of
the original estimate of probable cost ($240,870.00) plus the additional $500,000.00 described
above, for a total amount of $740,870.00, in the form of a bank letter of credit or maintenance bond;
and
Section 5: A bill of sale must be provided.

ILLINOIS, on this 266 day of February, 2007.
