WHEREAS, the Village of Lemont has received a Temporary Easement to provide for
ingress and egress to the I & M Canal Path on the westerly 30 feet of the property legally
described on the document attached hereto as Exhibit A; and
WHEREAS, said Grant of Easement shall provide the Village of Lemont access for
maintenance of the I & M Canal and pathways.
NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont that the Grant of Easement attached hereto as Exhibit A is hereby
approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DU PAGE,

TEMPORARY
EASEMENT AGREEMENT
THIS AGREEMENT is made and
entered into �on this 111h day of
, 2007, by and
between LEMONT INDUSTRIAL
DEVELOP ENT, LLC, hereinafter
referred to as "Grantor ", and the
VILLAGE OF LEMONT, a Municipal
Corporation, hereinafter referred to as
"Grantee ".
WITNESSETH:
WHEREAS, Grantor is willing to grant and assign to the Grantee, a temporary easement for
ingress and egress subject to the terms, covenants and conditions hereinafter set forth:
NOW, THEREFORE, in consideration of the mutual promises and undertakings and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the
Grantor hereby grants a Temporary Easement for Ingress and Egress to the VILLAGE OF
LEMONT, its successors and assigns, for the full and free right of ingress and egress over the
Westerly 30 feet of Grantors' property.
PARTIES agree that the attached drawing, identified as "Exhibit 1" describes the Easement Area.
GRANTOR represents and warrants to the Grantee that Grantor is the true and lawful owner of the
following described property and has full right and power to grant and convey the rights conveyed
herein:
Lot 2 in C.E. Boyer's Subdivision recorded June 24, 1879 as Document No. 227262, in Section 22,
Township 37 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois.
Property Address: 11201 Boyer Road, Lemont, Illinois 60439
Permanent Tax Index Number: 22 -22- 100 - 017 -0000
IN CONSIDERATION forthe Grantors conveying the above- described easement, the parties agree
as follows:
1. Grantor shall install a gate at this location with no trespassing signage.
2. Grantor will provide Grantee with a key for said gate and Grantor will be allowed to use the
I & M Canal Path for emergency evacuation purposes in the event of an incident in which
access across the railroad tracks at Boyer Road is blocked.
3. Grantee will be allowed to access the I & M Canal Path from Boyer Road for maintenance
of the Canal and pathways, and will notify Grantor prior to accessing the easement.
4. Grantee will remove the berm from the northern end of the proposed access area.
5. Grantor has the right to terminate this Easement upon 60 days written notice to the
Grantee.
GRANTORS shall not construct improvements in the Easement Area or change the finish grade
of the Easement Area without the consent of the Grantee.
THIS EASEMENT is binding upon and shall inure to the benefit of the heirs, successors, assigns,
and licensees of the parties hereto.
