R-34-06 04/17/2006VILLAGE OF LE ONT RESOLUTION No. 34 -o6 DATE: 4 - - ©(p A RESOLUTION AUTHORIZING ACCEPTANCE OF PUBLIC IMPROVEMENTS AND RELEASE OF LETTER OF CREDIT FOR KENSINGTON ESTATES SUBDIVISION (PHASE 1) WHEREAS, the Village of Lemont has adopted Ordinance 456, the Subdivision Regulations of the Municipal Code, to provide for the orderly growth of the Village and those territories within one and one half miles of the corporate limits; and WHEREAS, in accordance with Section X of the Subdivision Control Ordinance, the Village Board of Trustees shall consider requests to accept public improvements upon completion of same; and WHEREAS, Ed Mansell, the developer of property known as "Kensington Estates (Phase 1)" has petitioned the Village for acceptance of the public improvements in said subdivision; and WHEREAS, Village Staff and the Village Engineer have reviewed Kensington Estates Subdivision (Phase 1) improvements for compliance with approved plans, the Lemont Subdivision Control Ordinance and the August 23, 1999 Kensington Estates annexation agreement, and recommended approval of the request; and WHEREAS, the Village will release securities held to guarantee installation of the public improvements since they have been found to be satisfactory, excepting a letter of credit maintenance guarantee for a period of two years from the date of acceptance, and a separate guarantee for certain trees. NOW, THEREFORE, BE IT RESOLVED, that the Village of Lemont President and Board of Trustees hereby accept Kensington Estates Subdivision (Phase 1)" in accordance with the terms of the Lemont Subdivision Control Ordinance subject to the following conditions: 1. A two -year maintenance guarantee shall be posted equal to ten percent of the original estimate of probable cost, or $91,143.50, in the form of a bank letter of credit. 2. A separate performance guarantee of $7,200.00 will be held against installation of trees for lots 3, 4, 14,18, 19, 22, 28, 35, 37, 38, 39, 40, 44, 48, 49, 53 and tree replacement on lot 37 and outlot A. Jim. Cainkar. dated Nov: 30, 2005 regarding the tree inspections for Kensington Estates. At this point Kensington Estates is complete with the exception of final trees on lots.3, 4, 14, 18, 19, 22, 28, 35, 37, 38 39, 40, 44, 48; 49 and 53. We have to replace a tree on lot 37 and outlot A which will be done in the spring as soon as weather permits. Would you please put Kensington Estates I on the agenda for Village acceptance of our subdivision contingent only upon the aforementioned trees being accepted at a later date. Acting Village Engineer Village of Lemont 418 Main Street Lemont, Illinois 60439 RE: Kensington Estates — Unit 1 Punch List Dear Mr. Cainkar: \'C n • November 24, 2005 As requested, 1 have visited the site, met with Mr. Mansell, and reviewed the Parkway trees at the lots listed in Mr. Mansell's letter of November 7, 2005. The following comments summarize this review: 1. The parkway trees at the following lots were reviewed and were found to be acceptable: 10, 15, 16, 17, 21, 23, 24, 26, 27, 31, 35, 45, 51, and 52. 2. At lot 37 the tree west of the drive is to be replaced. 3. One tree will be replaced at Outlot A. 4. No parkway trees were planted at the remaining lots listed in Mr. Mansell's letter due to ongoing construction or the lots being vacant. 5. If the Village accepts the subdivision improvements, then 1 will schedule a inspection in the spring of 2006 for the maintenance period and to review the trees planted at Outlot A and lot 37 and any additional trees that may have been planted on the remaining Tots Please call if you have any further questions_ Sincerely, URBAN FOREST MANAGEMENT, INC.
