WITNESSETH: WHEREAS, the Illinois Constitution, 1970, Article 7, Section 16, authorizes units of local government to contract or otherwise associate among themselves in any manner not prohibited by law or by ordinance; and WHEREAS, the 5 ILCS 220/1 et seq., entitled the "Intergovernmental Cooperation Act," provides that any power or powers, privileges or authority exercised or which may be exercised by a unit of local government of this State may be exercised and enjoyed jointly with any other local government; and WHEREAS, the Local Governmental Property Transfer Act, 50 ILCS 605/0.01 et. seq. Article 5 of the Illinois School Code, permits the transfer of school district property to a local municipality; and WHEREAS, the Village of Lemont is desirous of acquiring certain real estate owned by the Board of Education commonly known as the "Bowl" for flood control; and WHEREAS, the Board of Education has determined that the property commonly known as the Bowl adjacent to Central School of Lemont, Illinois (legally described on Exhibit "A" attached hereto and made a part hereof) is unnecessary, unsuitable or inconvenient for further use as a school for the uses of the Board of Education; and WHEREAS, the Board of Education has additional, future developmental needs to manage the facilities and develop facilities to accommodate growth that require cooperative efforts with the Village of Lemont; and WHEREAS, the Board of Education and Village Board wish to collaborate to meet the needs of the Village and the needs of the Board of Education, these public bodies have agreed to enter into an Intergovernmental Agreement to transfer property and to assist in future planning to assist with school district growth, now therefore be it resolved by this Board of Education NOW, THEREFORE, in consideration of the foregoing Recitals and the covenants and conditions hereinafter contained, the adequacy and sufficiency of which the parties hereto hereby acknowledge; the parties hereby mutually agree as follows: 1 D , s # i i l3 TAE !� a) 6R 1 bj i t* L') J'`� � , o P , ai t - Support zoning amendments to allow the former District 113A bus lot lits pd "' ..,e, i'c (three lots) on Czacki Street adjacent to the Central School for L „ J 4v- ii E. iS urposes of sale; and 1.
