ORDINANCE NO. 6-69-07 AN ORDINANCE GRANTING VARIATIONS FOR HEIGHT AND SIGN AREA AND A SPECIAL USE FOR AN NON - ELECTRONIC CHANGEABLE COPY SIGN AT 25 WEST CUSTER STREET IN LEMONT, ILLINOIS (Lemont United Methodist Church) WHEREAS, William Stelter, hereinafter referred to as the Petitioner ", is a Trustee for Lemont United Methodist Church, located at 25 West Custer Street, hereinafter referred to as "the subject property," and legally described in Exhibit A; and WHEREAS, the Petitioner is seeking variations for height and sign area for an institutional use sign in a residential district; and WHEREAS, the Petitioner is seeking a Special Use to allow a non - electronic changeable copy sign for a institutional use sign in a residential district; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on August 7, 2007 and voted 6 -0 with one member absent to recommend approval of the Special Use and related variations with the finding of facts attached as Exhibit B; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village has reviewed the matter herein and has determined that the same is in the best interest of the Village of Lemont, and herein adopts the finding of facts as set forth by the Planning and Zoning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DUPAGE, AND WILL, ILLINOIS: SECTION 1. Variations: A height variation of 2.5 feet is granted to allow the freestanding sign to be greater than five feet in height and have a maximum height of 7.5 feet. A sign area variation of 18 square feet is granted to allow the same freestanding sign to have a sign area greater than 30 square feet and have an maximum area of 48 square feet. These variations are granted with the following conditions: 1. That the variations are only for a sign that is constructed consistent with Exhibit C. 2. A masonry or stone /limestone base is required. 3. That all requirements for illumination of institutional signs in a residential district shall be met. SECTION 2. Special Use: A Special Use is granted for a non - electronic changeable copy sign with conditions as follows: 1. The overall area of the message center shall not exceed 7.5 square feet. 2. There shall be a maximum of three lines of changeable text. 3. The maximum height of the changeable letters shall be three inches. 4. The background of the non - electronic message center shall not be white. SECTION 3. That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION 4. The special use and variation shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation and special use is made and construction commenced within one year of the date this said Ordinance becomes effective. The height and sign area variations, as well as the special use for the non - electronic changeable copy sign are in harmony with general purpose and intent of the Zoning Ordinance, which is to control the overall bulk of signs. The variations are needed to allow an attractive sign to be built. 2. The requests for the height and sign area variations are the result of trying to create an interesting sign that mirrors the look of the church. 3. The height and sign area variations, as well as the special use for the non - electronic changeable copy sign will not be detrimental to the health, safety and welfare of persons residing or working in the vicinity.
