AN ORDINANCE GRANTING AN AMENDMENT TO ORDINANCE 0-12-05
(SPECIAL USE FOR A PLANNED UNIT DEVELOPMENT) TO CHANGE
BUILDING ELEVATIONS AND SITE PLANS FOR ONE RETAIL BUILDING IN
LEMONT VILLAGE SQUARE
WHEREAS, the Village Board of Trustees approved Ordinance 0-12-05,
granting special use for a planned unit development and rezoning to B-3 PUD for Lemont
Village Square, located at 1237 S. State Street in Lemont, Illinois, hereinafter referred to
as the subject property and described in the attached legal description as "Exhibit A,"
WHEREAS, OS Lemont Development Company, owner and developer (the
"applicant") of the Lemont Village Square located at has applied for a special use for a
supermarket to locate on the subject property, and as part of the plans for the supermarket
has submitted revised building elevations, attached as Exhibits B; and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont,
Illinois, in accordance with said Zoning Ordinance, opened a Public Hearing on the
application on April 3, 2007, and closed said Public Hearing on July 17, 2007; and
WHEREAS, a notice of the aforesaid Public Hearing was made in the manner
provided by law and was published on October 23, 2006 in the Lemont Reporter Met, a
newspaper of general circulation within the Village; and
WHEREAS, the Planning and Zoning Commission has recommended approval
of the request for amendments to Ordinance 0-12-05 by a vote of 5-1; and
WHEREAS, the President and Board of Trustees of the Village have determined
that the best interests of the Village will be served by approving the amendments to
Ordinance 0-12-05 find that the amended plans will enhance the architectural and
aesthetic qualities of the Lemont Village Square,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF
COOK, DuPAGE, AND WILL, ILLINOIS:
SECTION 1: The foregoing recitals are incorporated herein as though fully set
forth.
SECTION 2: Amendments to Ordinance 0-12-05, altering the building
elevations and site plan and as depicted on Exhibits B and C, are hereby granted.
SECTION 3: The amendments are granted with the condition that the masonry
products and other materials indicated on Exhibit B are the same as those installed on the
facades, i.e. west elevations, of the buildings within the Lemont Village Square PUD
existing at the time of approval of this Ordinance, and that any deviations from or
substitutions of said materials shall be approved in writing by the Community
Development Director and the Chairman of the Planning and Zoning Commission.
SECTION 4: This Ordinance shall be in force and effect upon its passage,
approval and publication in pamphlet form as provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL,
AND DU PAGE, ILLINOIS, on this 22nd day of October, 2007.
