AN ORDINANCE GRANTING THE REQUEST FOR A SPECIAL USE FOR A SUPERMARKET IN A B-3 ARTERIAL COMMERCIAL DISTRICT, LEMONT VILLAGE SQUARE LEMONT, ILLINOIS (Aldi's) WHEREAS, the Village Board of Trustees approved Ordinance 0-12-05, granting special use for a planned unit development and rezoning to B-3 PUD for Lemont Village Square, located at 1237 S. State Street in Lemont, Illinois, hereinafter referred to as the subject property and described in the attached legal description as "Exhibit A," WHEREAS, OS Lemont Development Company, owner and developer (the "applicant") of the Lemont Village Square located at has applied for a special use for a supermarket to locate on the subject property; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, opened a Public Hearing on the application on April 3, 2007, and closed said Public Hearing on July 17, 2007; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published on October 23, 2006 in the Lemont Reporter Met, a newspaper of general circulation within the Village; and WHEREAS, the Planning and Zoning Commission has recommended approval of the request for a special use by a vote of 5-1; and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by approving the Special Use Permit by the standards of the Special Use Procedures, §XVIII.J.3 of the Lemont Zoning Ordinance, and find that the supermarket will be an appropriate use for the Lemont Village Square, will add to the shopping options of the citizens of Lemont and the surrounding area, and will not adversely affect traffic or parking, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: SECTION 1: The foregoing recitals are incorporated herein as though fully set forth. SECTION 2: A special use is granted for the establishment of a supermarket on the subject property, pursuant to §XVII.J of the Lemont Zoning Ordinance. SECTION 3: Said special use is granted on the condition that the applicant, upon approval of this Ordinance, immediately seeks approval of an ordinance amending the Lemont Village Square PUD plans to allow building and site alterations as indicated in the plans attached as "Exhibit B." SECTION 4: This Ordinance shall be in force and effect upon its passage, approval and publication in pamphlet form as provided by law.
