AN ORDINANCE GRANTING A ZONING MAP AMENDMENT FROM LEMONT B -3 ARTERIAL COMMERCIAL WITH A SPECIAL USE FOR A PUD TO R -4 SINGLE FAMILY DETACHED RESIDENCE DISTRICT WITH A SPECIAL USE FOR A PUD FOR PROPERTY LOCATED AT THE NORTHEAST CORNER OF COVINGTON DRIVE AND 127TH STREET (COVINGTON KNOLLS PHASE 8) WHEREAS, Gallagher and Henry, hereinafter referred to as the "Petitioner ", is the owner of approximately 7.7 acres, said parcel is located on the northeast corner of Covington Drive and 127th Street side, hereinafter referred to as the "Subject Property ", and is legally described in Exhibit "A" and depicted in Exhibit "B" attached hereto; and WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance for a zoning map amendment of the subject property from Lemont B -3 Arterial Commercial to Lemont R -4 PUD Single Family Detached Residence; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois, in accordance with said Zoning Ordinance, conducted a Public Hearing on the application and variation request on October 16, 2007 and recommended approval to the Village Board; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont that: Section 1: A zoning map amendment is granted to allow a change in the zoning classification of the "Subject Property" from Lemont B -3 PUD (Arterial Commercial) to R-4 PUD (Single Family Detached Residence District). The "Subject Property" shall be developed in accordance with Preliminary Engineering Plan and Subdivision Plat, prepared by Engineering Resources Associates, Inc. and with a revision date of October 25, 2007, attached hereto and incorporated herein as Exhibit "C ", and the Preliminary Landscape Plans, prepared by The Olsen Design Group, LLC and with a revision date of November 29, 2007 attached hereto and incorporated herein as Exhibit "D ", subject to the comments of the memorandum from the Village Engineer dated December 3, 2007, attached hereto as Exhibit Section 2: The conditions set forth in Ordinance 849 approving of the Covington Knolls Planned Unit Development shall apply to Phase 8 as well. Section 3: The Planned Unit Development approval shall lapse in the event the Petitioner does not file a complete application for a site development permit within one (1) 2 year of the effective date of this AGREEMENT. It was decided to light the fire lane from Overton Drive and Baimbridge Road, and not install bollard -type lighting on the path. Also, since the Department of Public Works must maintain the fire lane, they prefer something other than turfstone be used. This still needs to be worked out with Gallagher & Henry..
